Missing C of O?

Hi, We’re in the process of entering into contract on our 4-family house.However the buyer’s bank says they ordered a C of O certificate from the DOB and it says 3 rather than 4 units. Our house had the C of O changes about 9 or so years ago (before we bought it) The bank wants an updated C of O– where might this be? We don’t have..

Jock: I think this post came from the seller of the property, not the buyer. You might also check the DOF website to verify if the change (from 3 to 4) happened. Is the house listed as Class 1 (1~3 family)? We had a similar issue, although in other direction. We went from a 4 family to a 3, filed everything and got sign offs (including DOF changing us to 3 family Class 1). The DOB website only showed the temporary CofO and never the final. The DOB (at open owners night — you might try that too) told me that their records showed the permits and they were closed out correctly. It appears that the DOB simply did not scan the final paperwork. When I spoke to the DOB they told me everything was in order and not to worry (which I take with a grain of salt). If your permits show up at the DOB and the tax class change is in the DOF database, it could be that the DOB never entered the change. But there might have been an incentive by your seller to keep the house as a Class 1 property for lower taxes, in which case you could have an illegal use rats nest. Good luck….

Look to see if a permit was filed for the work. Going from 3 to 4 would have required a new c of o to be created. If it was filed but no c of o created then most likely it was filed pro cert and gotten away with. You would need to require the current owner to take care of legalizing it or maybe if the bank would allow have $$$ held in escrow for you to take care of it.
