Lease question
I have resided in the same house for 2.5 years. Ken, roommate has lived here for over four and my other roommate, Sarah has lived here for about a year. Ken has all the bills under his name and acts as the liaison between the landlord and us. The lease is up end of February and I was told yesterday by Ken that both Sarah and I have to leave by the end of February because he doesn’t want roommates anymore and the landlord has put him in charge. Now, after this cold behavior by Ken I don’t want to live here anymore, however I was planning on renewing. I can’t help to think that this is unfair and discrimination because Sarah and I are both females and Ken is male. Any advise? Should I fight Ken and my landlord and make a discrimination case or should I just shut up and move on?

Unfair? That claim carries many inferences (about you) and has no legal implications. If it is legal it is fair because you don’t own the building, and if Ken’s story is accurate, it is also legal from a notice perspective if it is a market rate apartment (landlord owes you no notice AFAIK). You have not said whether unit is stabilized or market, so what else can we assume with no facts. Ken said that he doesn’t want roommates, I am confused as to what is discriminatory. However, i would try to corroborate Ken’s story (about being the rightful arbiter in such matters) directly with the landlord, and since you are a lessee, it is completely reasonable that you attempt to contact your landlord. Ask the LL if he could let you know as a courtesy if they intend to extend your lease, you didn’t receive notice directly from them but just wanted to follow up for planning purposes (play dumb about what Ken said). Be polite and don’t infer any roommate drama. If they corroborate that Ken makes the decision, then it can be assumed Ken is acting as their agent in the decisio n to renew your lease, and you will speak with Ken and work it out. If they don’t return your calls but contacts Ken instead, it could probably also be assumed he is acting as LL’s agent. You are RECORDING all this….. correct? Good. Then go to Ken (now that you have confirmation he is acting as the owners agent in such matters) and try to ask pointed questions regarding if he doesn’t’ like to rent to women. If he denies it is a sex related thing, move on you’ve got nothing. If engages about what a pain in is to have female roommates etc, you have a possible case on tape (you are recording all this right?).
But…maybe Ken wants new roommates or really does want to live alone, and landlord is accommodating since he has been there the longest and has been responsible. Who knows, maybe he just doesn’t like you – that is not discriminatory. Bottom line is…. do your homework and legwork instead of lazily chasing unfounded accusations. Personally i can see where Ken might have issues with his living arrangements! Does he have a roommate or a child?

If you are all on the lease, you all have the same rights vis a vis the apartment. Perhaps you and Sarah want ken to leave. It is LL’s call who to rent to.
PS Unless you have heard the LL say something discriminatory or has a pattern you can document of only renting to men, put away thoughts of a discrimination claim.

Also definitely talk to the landlord as they’re the only relevant party in terms of renewing the lease. If all three are listed, each had equal claim to the unit regardless of tenure

Ken has been there the longest, and seems to have the relationship with the landlord.
You do not mention if you are named on the lease or if the lease is a rent stabilized lease. So assuming that you are not named on the lease and the lease is not rent stabilized… the landlord can rent to whoever he wants. Renew the lease or not renew the
lease to whoever he wants.
If you are all named on the lease and it is rent stabilized, then you will have a case because you are a rent stabilized tenant that has a right to the lease even if Ken & your other roommate leave… but only if the landlord can see that you can afford it by yourself, he does not have to accept additional roommates.
Very few disputes of this kind are due to discrimination and do not claim it so quickly; it diminishes the very real serious cases of discrimination.
