Lead tests
I just heard that there’s a new law about lead testing that will go into effect in 2025. Anyone know the details?

Thanks, I hope so! For some reason I had thought that owner occupied units in 3 families needed to do the testing, but I can’t figure out why now. We had it done last year and the price was probably on the lower end, but the tester cancelled our appt and we came really close to not meeting the deadline.

To add to Prime above, I had an environmental specialist out and he said that you do NOT have to abate lead found in non-impact areas, like walls/ceilings/etc, unless it’s peeling or flaking. So a wall that tests positive for lead but is in good shape does not need work done.
Abatement must be done on all impact areas that test positive, like doors, door mouldings and surrounds and windows and window mouldings.

This took effect in 2021 and you had until August 2021 to test any units with a child under 6 for lead based paint and lead dust. If you didn’t have a tenant with children at the time but you do now then you have a year from the time the child first moved in to test and all rental units, regardless of child or not, are required to be tested by 2025 with XRF analysis. They also lowered the threshold for lead paint to .5 milligrams per sq centimeter. If you find lead then you must pay to get it abated. You have until August 2025 to XRF test all surfaces no matter what except in owner occupied units. All testing and abatement must used certified pros. Property owners and managers are required to keep all their records for notifications and abatement for 10 years. Basic summary. I’ve heard the abatement can be quite expensive and I don’t see how all these mom and pop owners with a renter in their 1850s brownstone can afford to do a large lead abatement and keep apartments empty. Supposedly HPD is auditing to catch folks….
