Lawyer insights needed new building next door

Hi everyone,

A developer will soon be purchasing the empty lot next to our 3 family brick building on a residential block in Brooklyn (where we live). I don’t have personal experience with this but someone will need to inventory and document existing conditions, a lawyer will need to negotiate an agreement with the developer, you may need a crack or vibration or other monitors in place, etc. If they are excavating, pile driving, or doing anything else under the ground, there could be danger of compromising your foundation. They will need to file everything properly, including a separate asbestos test for the roof only (in addition to the regular asbestos test). Old houses made of brick and even wood frames are vulnerable to adjacent construction, and not to be alarmist, but a handful in Brooklyn have unfortunately been structurally compromised and demolished as a result. Of course, with good monitoring, this will hopefully not be an issue at all.

a lawyer is a wise choice.

i have managed buildings and we always had them list us as additionally insured on their insurance and made them provide protection on our property but i am sure there is a lot more to this than that and others can help with more-
