Landmark application with possible work not previously filed?
We are submitting an application for a rear deck and our house is in a landmarked district. In my research and putting this application together we realize some work was done to the facade may not have been previously filed for. I went to the DOB and there were no records of any previous jobs filed. Since the landmark designation, some windows were changed in the rear and the brick facade was painted with thorocoat. 1) Will I be penalized if this uncomforming work is noticed in my application for the deck? 2) Does landmarks send an inspector to check for compliance? 3) Does the LPC work in cahoots with the DOB? We are worried about some windows that were probably not filed for. TIA

Hi resident2 – what you are saying is exactly what I thought would be the case, however, they are asking for a lot more information than we sent – photos of our yard and facade, photos of our neighbors yards and facades, close up photos, details, etc. In the initial application I included deck drawings and a site plan showing entire block and photos from the public thoroughfare proving that the deck is not visible. Do you know why they are being so persistent?

I am guessing you are applying to Landmarks for the no effect clause? Or can your proposed rear deck be seen from any public street?
If it is the first. They just look at your plans, maybe look at a block map and if they see that it does not effect the public view, they rubber stamp your plans with no objection to your deck. In other words if your plan does not effect the Landmark portions of the house they do not care. They will not inspect based on this.

unfortunately, as the owner, you’re responsible for unapproved work done by a previous owner. you can be penalized for it. landmarks will review and inspect for compliance. i don’t know how closely LPC reviews DOB permits to compare to existing conditions, but if they come on site they’ll notice a funky window. The good news is that rear facades tend to be less closely monitored since they’re not visible from the street. so… it’s hard to say for sure what will happen… but they do have the authority to make you fix things.
