Landlord pest control in backyard?

Hi – whose responsibility is keeping the outdoor garden which is solely used by the garden apt free of pests? I believe the lease says the garden comes as is – will double check – is it my responsibility as landlord to make sure the area is sprayed for bugs? thanks –

Brooklyn backyards are known to be full of mosquitoes and some are so bad they are unusable except in May. It is the tenant’s responsibility to make sure there are no containers catching water, such as saucers under pots or anything else. If there is some landscape or architectural feature that holds water or creates puddles, that is the landlord’s responsibility. If neighboring yards have buckets and pools of water, there is nothing you can do (unless speaking to the neighbor would help). We turned over some buckets in a neighbor’s yard this year with their permission and the weather has been dry so we have had little issue with mosquitoes this year, unlike prior years. Nonetheless you need to wear protective clothing, run a fan, and/or put on mosquito repellant. (As for sprays, it kills good bugs such as bees too, so we avoid that.)

And I’m always ready to fix things – but to come at me at the end of the month complaining about something and asking for a rent reduction – but never having given me the chance to address the problem is not the way. They agreed to the rent but I think they are having second thoughts about the price – telling me I’m not allowed in the apt to make repairs – yes they have told me I am not allowed to come in to the unit to “supervise” a repair (their quote marks) is not the way to ask for a rent reduction –

The difference Steve is that you’re far more competent than me, but my first landlord wasn’t too sharp. Luckily I had a friend who was very handy who showed me how to do stuff. And then there was the new electric outlet I snaked through the walls :-). I had worked one summer as an electrician’s helper and, although I had gotten good at snaking BX they never showed me how to make connections properly. At least the house didn’t burn down.

Right bob. Every landlord i ever had was always lowering rent or cutting deals with me because i never asked for anything (unless the heat was out) and was willing to roll up my sleeves when need be. When i started my actual legal business my landlord helped me get on my feet by giving me jobs and getting me work with her friends. I had done so much for her, when we bought this house, she gave us our last month’s rent for free plus our deposit back plus the interest. I have alwsys tried to asking nothing of landlords hoping the rent increases would be minimal.

Like Steve, I rented a garden apartment i(in the South Slope) and was thrilled to have exclusive use of, and responsibility for, the garden. It was good preparation for eventual homeownership. I wouldn’t have dreamed of asking the very inept owner to do anything. I also did a lot of maintenance and repairs—with the owner paying for the materials-/more good training—I guess I was destined to be a homeowner—even though I grew up in an apartment.

I have worked in big commercial buildings. Soon after arriving in nyc, i found there were two types of people; those who grew up in houses owned by their parents and those who grew up in apartments. The people who grew up in houses would often try to deal with stuff on their own or at least think about a solution more readily. For instance, if there was a thermostat on the wall and they wanted it cooler, they would get up and move the thermostat. If someone had left a window or fire door open and bugs were getting in, they would close it. People who grew up in apartment buildings would often call the building staff to do the simplest things. What i am suggesting is, because of where they grew up they would not think of doing what slimc is suggesting. Sometimes i am even a little surprised when i see a can off off around in a house in the city.

No you as a landlord are not responsible for controlling mosquitoes or fleas, nor are you responsible if they water the garden a lot & attract more mosquitoes etc, or mosquitoes from the neighboring gardens etc…. If there are rats, that is a different issue, but you will need to organize all your neighbors to deal with them.

A rent reduction because of backyard bugs seems ridiculous to me. I use Off repellant, PIC incense coils, and a fan to keep mosquitos away. Would never dream of providing them to a tenant or asking for them from a landlord.

I rented in a place right out of college. We had the downstairs. When we took the lease, we were told that mowing the back lawn was our responsibility. Only we had use of the back yard. I would not have dreamed of asking that landlord to do anything about the bugs or anything else. This took place in another time and in a small southern city – i think the given attitude was that if the landlord did not promise it in the lease, then nothing was due.

If they have use of that yard and sweep up and you promised them nothing, i would make the assumption that the bugs are something they have to deal with. Its sounds to me like younger people in nyc are expecting landlords to provide more.

Now you know. In the next lease, write that maintenance (not repairs but cleaning, etc) is the tenant’s responsibility. You will find a way to word it to include bugs.

The yard is for exclusive use of my tenant. I don’t have any access to it (I’m the landlord). The tenant is complaining that the yard is buggy and wants a rent reduction for that – I want to fulfill my obligations as a landlord but don’t feel
I can control an exterior outdoor space when it comes to bugs. Cannot find a good explanation of my obligations as a landlord in an outdoor space with controlling mosquitoes or fleas.
