Junk on roof: potential neighbor(s) dispute

Hello,

Wondering if I could get thoughts/advice ref this.

I purchased a gut renovated multi family home in BK in 2019 – l new roof etc and professional survey done with photos etc. House isn’t detached

Last month due to the floods there was a minor leak. When the roofer went to fix roof there was heavy duty industrial junk dumped + other things so he wasn’t able to fix the roof. I and the tenants were unaware of this – don’t visit/use the roof.

The neighbor next door recently has solar panels installed and a new roof and it seems based on that the items were dumped on my roof (including a steel rusted exit shaft that required 2-3 people to cut and or remove by hoisting down via ropes) and their proximity to that side, and the fact that he has a new shaft that it might be from the work his contractor did. Even bricks were thrown on my roof (assumed all this has been there at least 1-2 years) and melted and stuck to my roof)

It is costing ~ 4 figures to get this removed and the damage to be repaired before the roof is even resealed. The neighbor refuses to take resp onsibility and has attributed it to the neighbor on the other side – haven’t been able contact this person as he is a landlord and doesn’t live at that property.

Based on assumption, it clearly has to be on of the two houses – left or right. My house is the only gut renovated one with a new roof, clear of debris, and I’ve not needed to have any work done.

Any tips/advice on how to address this? I want to notify the neighbors of the issue, what I’ve had to pay and repercussions, including legal, of if this happens again.

so here is the way this could play out if OP decides to start putting the screws to this guy by bluffing with him:

first, an honest and upright contractor would not do something like this but if one did and you started telling him the detectives want to talk to him; 1. he might know you are bluffing and 2. he might not react much and 3. to keep the peace and be professional, he might not threaten to sue you but just might want this to go away (i would, as a contractor, if i got accused of something i did not do, something like this that could ruin my reputation, i would just want it to go away as fast as possible – i would not want my name mixed up in it and i would not be threatening to sue anyone). if he thinks his team did it, he should really do what it takes to resolve this –

with dishonest people, especially real bottom feeders, if you accuse them and they are guilty they might very well flip out and begin threatening you and disparaging you (more often than not that is how it happens; the guy i mention above shouted at me, calling me an “a**hole” for cont acting the DA’s office and another time someone said “you are a horrible person and i don’t ever want to see you again”; all fine with me). that is their defense mechanism to scare you and make you go away and to me, it is a sign of guilt. they won’t do that with the police, but they will do it with you.

you are at a disadvantage here because you do not know this person and how he responds in different situations and to stress. maybe he blows up all the time when things go wrong or maybe he gets quiet under stress when he has screwed something up; not knowing him and how he looks at you in different situations will make it harder for you to read him and know when to apply pressure and when to pull back.

did you or your roofing contractor take photos of your completed roofing job? or is there a warranty company that is involved on the roof? i would contact your roofer and see if they took photos of the completed job and see if they show the neighbor’s junk on their roof and guess what, home run. a lot of contractors take photos to prove that the job was done correctly if there is an issue later or someone calls to report damage that was obviously don’t later.

I’m with steve, how do photos from so far up prove anything. You can’t see any details and they will blame the other neighbor etc. It’s unlikely a moment in time view will show people traversing the roof or any details. Personally, I learned the hard way don’t drain yourself with sleuthing – very hard to prove this sort of thing unless you had a camera up there. But you should do what feels right to you.

Calling the DA, police, DCA etc may get them to admit it because they may cave under pressure and questioning. Police are generally apathetic however. Maybe your precinct is different. I have tried that route and got nowhere with it.

i worked in commercial real estate and we had to find all sorts of ways to get evasive people and even downright criminals to admit to things. i did what i say above twice to someone and both times it worked. the last time i did it i called the district attorney’s office and spoke to someone and they told me “make a statement and we will have an attorney look at it”. i never had to do that; i called the other party and told them the DA’s office asked for a statement. the other party got mad at me began shouting and admitted to what they did wrong and tried to blame someone on their team and told me i “was an a**hole for contacting the DA’s office. that they could have fixed it without me going that far.” problem solved.

if there is criminality here, call the DA’s office.

keep in mind. we, you, me, and most of the people reading this do not know what “evidence” is. a lawyer might look at this and see all sorts arrows pointing at the neighbori ng building and that contractor. and if they don’t you have to put your poker face on and bluff that contractor into thinking you have a strong hand of cards.

if you can swear that it was not there when you bought the place, i would press the issue with the police. if it is obvious where it came from, maybe the police will take it on ? i mean space aliens did not dump it there. you had a new roof put on so you know it was not there and did it damage your roof? can you make a case for criminality? illegal dumping is criminal, is it not?

call the police and see what they say. if they do not want to push it, you have to do it. call the contractor and tell him that the police think this is a very serious matter and will want to talk to him and his workers. so ask him if he can get his workers names together for them and perhaps he can meet with you and the detectives on the roof to explain who might have put it there. you might push him into saying “it must have been one of my men who put it there. i did not know they did it” and maybe he will do something about it.

i did this above with some one once and it worked just as i wanted it to.

If google photos can prove that the materials belong to your neighbor’s house, I’d show them the photos and I’d put the materials back on their roof while they figure out what (if anything) they want to do about it. If the photos prove nothing, I think you’re stuck dealing with it yourself.

Sorry you went through this. Awful.

Agree with mozeeatupu. If you can’t prove it there isn’t much you can do. I went through something similar but I had no proof. Think about the time and energy you may end up spending on trying to track all this down and if it’s worth it.

If you know the name of the roofing company who did the work, you could file with the DCA and see if they respond.

It is safe to assume given that work was recently done on one roof and their old hatch is no longer there and a heavy rusty one was dumped on my roof that it was probably theirs. This was among other things. However arguably it could be the house on either side. Hence I wanted to know what course of action I could have.

If you don’t know for sure who did it just chalk it up as a lesson learned, move on and secure the roof.
You have no real recourse against anyone.

Consider putting a security camera on your roof. I think it makes just as much sense as it does in the front and back yards.
