How to evict tenant/super from illegal basement apartment
The super has stopped paying rent for 2 months, how can I remove him from the house? Anyone have a lawyer recommendation.

There are many pre-war buildings that have supers apartments in the basement, that are not legal to rent out to the public, but are legal for a live in super. Any building of 9 or more apartments is supposed to have either a live in super or a super within a block or so.
You can legally evict a super from this kind of an apartment because he is no longer the super, but you cannot charge any kind of rent for it.
I always think it is a huge mistake to give a tenant the supers job. You either have a tenant that pays their full rent or you hire a super. Do not give a tenant a discount on the rent to be a super…. it always gets muddy.

More info needed to give you a good answer. Has management discussed the matter with the super? Do you know if it’s some kind of temporary financial issue or in some way related to his job? Like maybe he gets the sense you’re going to dump him so he’s stopped paying out of spite? Has anyone in charge sent a letter to the super informing him of his rent obligation and his lateness. This is a good idea because it starts a paper trail. Does the super have a lease? Btw, it seems like a pretty unique arrangement to have the super paying rent and it implies you pay him a salary. If so, and if you wanted to be less than nice, you could deduct the rent from his salary. At the very least, though, someone has to have a sit down with the super and figure out what’s going on.

Uh, if you’ve been renting him an illegal apartment I would highly recommend getting a very good lawyer for this.
