How do you go about proving a tenant

is not providing access to go into their apartment to do fixes needed to cure an HPD violation?

Our main problem is getting hpd off our back as the violations are not as bad as they sound, the tenant just wanted to act vindictive, they dont want the actual repairs of course. We heard there was a way to show NO ACCESS so that HPD would not follow through with pursuit of penalties, etc…

I don’t think the problem is what’s in the lease, but the practical element of securing the access described in the lease. If the tenant refuses to admit you to the apartment for the repair(thereby violating the lease), I don’t think there is a procedure to physically compel them to let you in other than an eviction.

It’s a problematic situation created by the current rules. You may have to commence an eviction proceding for violating their lease by refusing to admit your repair people, and then negotiate from there.
