Expanding tree pit near gas cap
We wanted to expand the tree pit in front of the building since it was recommended by a parks dept worker since it’s a huge tree with just enough opening for it’s trunk.
The issue is that 1’ over is one of those sidewalk caps for the gas. Can one of those caps be left in a dirt tree pit area? And I know a permit might be needed if doing this myself, just wondering how to deal with the gas cap and what is usually done.

Interesting. However, I was served with a violation that included a damaged curb.

States the following on the 311 website. — “The Department of Transportation (DOT) will inspect the condition of the curb and sidewalk at the location. If a sidewalk is found to be defective, the property owner will be notified. If a curb is missing or damaged, the City may repair or replace it at no cost to the property owner.”

I’m pretty sure the curb is the responsibility of the city / DOT. Homeowners are responsible for the sidewalk only, not the curb; though they encourage homeowners to repair the curb as well when they fix the sidewalk. Yes, if I put in a curb complaint, they will inspect the sidewalk as well when checking out the curb and issue a violation for the sidewalk if needed, but not for the curb.

The homeowner is responsible for the curb. If you call them, DOT will come out and issue you a violation, requiring you to fix it.

Not sure about the regulations / legality but the sidewalk gas cap for my property is located in an open tree pit – raised 1-2 inches higher than the surrounding dirt but level with the general sidewalk. When Con Ed recently upgraded the gas line coming into the property, they placed a new gas cap a foot away from the old one but still in the tree pit. They certainly didn’t concrete the gas cap in place. Plus the curb is missing / broken in that area so I won’t be surprised if a car backed on top of of the old cap once or twice before while parallel parking… Really got to get the city to fix that curb!
