Evicting tenant

Does anyone have any advice on how to go about telling a tenant who has been there for about two years that you want the apartment vacated? There’s no lease. Would/have you sent a certified letter or just given a letter in person? How much of a notice do you give? Any other advice?

Holdover is when a lease or a rental agreement comes to an end and the tenant does not vacate and overstays.

It still takes about the same time for the process of holdover and non-payment to get started 3 months. Non-payment which means someone not paying the rent on time and then also not paying after you send a demand letter. A non-payment requires a lawyer from the start. Holdover is you tell them that you will not be renewing their lease and based on their length of tenancy give them a certain amount of time. Sometimes with a holdover they leave, ask of more time, or overstay. When they don’t ask for more time or don’t pay, I would get a lawyer. I can recommend based on filed cases who is experienced and you can select who to call. You should see who offers a free consultation and talk to them to see how responsive they are. When going down this path, the building should be registered in the HPD if required to do so. All paperwork certified mail. They check things like if you have a mortgage and other nuisances like the HPD registration in their decision making in courts

Tenants who have lived there 2 or more years require 90 day notice. Less than 2 years but more than 1, it would require 60 notice. I would give a certified letter things tend to get heated when this process is started. They are trying to pass laws in NYC to prevent landlords from filing holdovers. If in the three months., they stop paying you may want to consult a lawyer. I also can recommend lawyers based on your borough based on case filings not personal experience.
