Evicting a Subtenant?

A friend of mine has been leasing out his (furnished) apartment since late last year to a family of three. They have not paid the rent in two months and continue to produce ridiculous excuses akin to the check is in the mail. He doesn’t want to lose his apartment, but August 1st is coming and he cannot continue to pay his rent if he’s not getting paid. He asked me how he can evict his subtenants and I actually don’t know for certain if a tenant can go to Housing Court to evict a sub-tenant. I assume he can, but I don’t want to give him poor advice. FWIW, he does have a sort of skimpy lease with the subtenants, so at least it’s not as if nothing was ever put down in writing. So, does he just start a non-payment in Housing Court in the same way any landlord would, or is the process different? Thanks.

True. You have to give the notice at the end of a rental period, meaning one month. If you give the letter Aug 10, you have to give the tenant until Sept 30 before you can begin eviction proceedings.

If he waits until August 1st to serve the demand so he can include the additional month, would the termination date be August 31st or would it have to be September 30th? If it’s September 30th, it would seem to be better to serve the demand tomorrow for what’s owed now and get the petition amended in court later if the family puts in an answer, true?

Same process as any landlord. You have to give the subtenant a written notice to evict before the beginning of the next month. Mail it certified and first class. The notice would either have Aug 31st or Sept 30 as the date they must leave by, depending on when you send it, and if they do not, you will begin eviction proceedings and follow thru. I would strongly suggest using an attorney for the court proceedings.

Yes, the lease allows for subletting and the apartment is not subject to rent stabilization (or control).
