ERV Renovation Requirements

We are undergoing a near gut renovation of our mid1800s 4story+cellar row house, and our mechanical engineer is telling us recent code requires ERV. I can find references to new builds or non-residential code, but nothing about 1-2 fam homes.
(This isn’t a question about the benefits, we understand that, just what is required)

I just did a gut to my single fam. Energy code definitely did not call for an ErV for us. Although I considered installing one. NYC is not that forward looking yet. Idk you specs are but would be interested why you are required to install an ERV. FYI the engineer who filed my plans including energy code didn’t even know what an ERV was.
