I guess we have no Beatles fans ( fixing a hole when the rain gets in……) no one responding to my question from yesterday. Jim Hill or anyone out there, please: Do I need a permit to fill this hole in my rear yard ( was an old foundation for a rear building). Have you looked into booming it over the house? I’ve never done it but have used United (718) 726-6111 and Auers (212) 427-7800 for a lot of rooftop projects and they can be pretty creative.

Thank you as always for your thoughtful response. You are correct that this is more a “lower yard” than a hole. This was created when they removed the foundation of the rear unit. I guess I need to think a work around (inverse tree house is a good idea) but what we were looking for was making the outdoor space more usable by somehow minimizing the level drop. Back to the drawing board. Thanks for all the helpful and thoughtful comments.

I may not be seeing the picture correctly, but I don’t see a hole. I see a lowered rear yard. Am I missing something? Can you post another photo, or clarify the situation?

If it is just a lowered rear yard, then there may be code implications, like raising the level of grade outside the basement (garden level) dwelling unit or rooms. If you do that, you could be reducing access to light and air from the spaces in that unit/rooms. If that’s the case, then you could create non-compliant living spaces.

And to order that much soil, it could be considered “fill” as opposed to topsoil, which is regulated as it may contain chemicals. If my understanding of what you are doing is correct, you might just need that permit.

Now, Bob may say I’m crazy for suggesting a permit, but as someone whose license depends upon following the rules, I tend to be a bit more conservative when it comes to this sort of thing.

And if I’m wrong in my interpretation, then I’m all for the tree house in reverse.

Any rules don’t matter much IF you move it to the back quickly. I’d think it has to be with buckets–wheelbarrows would make quite a mess. It will be a back-breaking job!

Dumpsters don’t get delivered full of dirt. You need to figure something else out. I don’t know if there are any rules governing loads of dirt being dumped on the sidewalk in front of your house but that’s likely the way you’re going to have to do it. And then transport it by buckets or wheel barrows back.

The place you rent the dumpster from gets the permit. But that’s usually for an empty dumpster that gets filled. Better check with whoever you’re getting the fill from
