Developer Delays, Advice?

I’m in the midst of dealing with substantial developer delays. My developer, Joe and Amy Miller of Park Slope, have no experience and while construction of the apartment is basically done, he has no idea how to file DOB forms and did not hire an expeditor. Anyone else on the board have this experience or any advice?

I know the Plumbing and electrical have been signed off on, but that there is an outstanding mechanical inspection that was recently cancelled for an unknown reason. The plan has been amended countless times due to paperwork error, so I do expect something else to happen. We’re already 5+ months past projected completion date.

@sthslpr24…potentially both. The C of O process is where lots of minor decisions made during construction suddenly have to be dealt with. So that wall that was moved over slightly for one reason or another? If the C of O inspector notices it, drawings will have to be amended and resubmitted. Or if you installed a different boiler because the one that was spec’d on the drawings had a 12 week lead time, now is when it will come to light that the model on site doesn’t match the MEP drawings, the architectural drawings, or the equipment use permits, and all will have to be amended. It’s possible none of these type items will arise, but assume they will. Are you sure that all TR-1’s for both controlled and progress inspections have been signed off and submitted? And that all plumbing/electrical/sprinkler work is completely signed off on? I’ve had experience with a developer who didn’t know what he was doing and I would ask a lot of questions as to how construction was done in terms of things you can’t see like insulation, plumbing, etc. When you have an inspection done, I would recommend using someone with a thermal imaging camera so they can see beyond the walls.

The plans have been filed and approved, but there are lots of other steps that need to take place after the plan filing but before the CO can be approved.

They should have filed plans with DOB. It is hard to do so after the construction is done. The plumbing inspections alone will require opening up to see what was done.
