Delays at DOB?

My husband and I have been in contract to buy a house in Bed Stuy since the beginning of the year. Of course Covid has screwed everything up (and we know we’re not the only ones!!) but the big hold up is the Certificate of Occupancy (we didn’t realize they still needed inspection sign off on the plumbing and electric and there was no CO when we went to contract in January). Of course it took awhile to get the inspectors back once the city opened in June, but they finally had the inspections completed in August and we’ve been waiting since then for the CO. However, I feel like our seller isn’t being completely transparent with us. I know the DOB is totally backed up, but is it normal to take 10+ weeks to get a CO after the sign off on all inspections? Our seller has an expeditor, but that doesn’t seem to have accelerated the process.

Our lease it up, we’re about to be homeless (with a 2.5 year old and two large dogs) and I’m just trying to get an idea on how much longer it might be. Has anyone been dealing with the DOB recently and can offer some insight (or optimism)? Better yet, does anyone have a contact there who might be able to help? Would it help if I went to the DOB in person to plead my case even thought we don’t even own the house yet?!

To put it in perceptive:
I recently passed an exam for one of the new qualifications the city instituted. I passed two months ago, but I still cannot use the new qualification…because I cannot go pick up the card from the DOB. Literally I cannot do the testing that I am now qualified for, which would be big for our company, because they are so booked up for a two-minute pick up appointment.

i’m going to echo resident2 here, DOB is a bit of a shitshow right now (i was recently told that many of the staffers are working only from 10am-2pm and if you don’t call right at 10am you’re unlikely to be able to speak to someone that day… i can’t confirm that, but the speed at which things are moving does seem to bear it out). can you speak directly to their expediter to find out what their plan is?

Yes, there are many delays at the DOB. That said the sellers Broker / Seller themselves / sellers Attorney should be more forthcoming with information. What is your Attorney / Broker doing?
As for your lease, you cannot be evicted during the Covid situation. That said, get in touch with your landlord & explain that you will not be able to move out at the end of the lease. All owners /landlords are dealing with tenants not being able to pay, breaking leases, etc. You needing to stay & keep paying the rent will be no problem compared to what many Landlords are dealing with.
No, do not go to the DOB yourself. As you say you are not the owner, other than publicly accessible information; which is very confusing if you do not know what is being done. They cannot help you.

Is this brand new construction, or were the sellers changing the occupancy? If not, a C of O should not be needed. If it is needed, how long it will take to get one is anyone’s guess. Worst-case scenario, the lack of one could potentially indicate big issues that will be extremely expensive to fix. Plumbing, electric, and gas all signed off on and complete? You are sure? If you have a seller’s broker, they could be useful in this situation. Maybe your attorney can find out more. If there are issues, and the seller can’t get a final C of O, they may try to get you to close and/or move in without one, which would be a no-no. If you are getting a mortgage, probably the bank won’t give one. Good luck.
