Buying a house with open DOB violations

We are so happy that the seller accepted our offer. Now we are working with our attorney on finalizing the contract. One item that the attorney brought up is that the CO shows a garage but the seller converted it by closing it off with brick/mortar and a door. The garage is supposed to be at the rear of the building. The attorney warns that we might have issue getting a mortgage from the big banks (chase, citi, hsbc).

I contacted the banks and they all agree that as long as there is no open violation on the garage/conversion, there should be no issue. Now, worst case scenario, the attorney sees an open DOB violation in 2006 (construction) but it doesn’t show any detail of what it is. The title search would show it but thats after we apply for the mortgage. What can we do in this case? if we apply for a mortgage at the big bank and they see the violation for the conversion, would they just deny our mortgage since it will be the last stage of the process. The seller wont have time to fix the open violations I assume? or would the bank allow the seller to put money in the escrow for us to resolve when we buy it?

I know smaller banks will allow this to slide but the rates are 1.50% higher. Any advice would be greatly appreciated.

Is there really no info online? Go to the DOB website and look up all the jobs and violations. Click through enough and you should get some detail.
