Buying a house with a violation

I am a first buyer and this is all new to me. I have put an offer on a 1 family building in Brooklyn. Offer accepted. As I brought up the violation to the realtor, he said he would get credit from owner. Owner offered $5k credit at closing. The violation is a 10×12 extension built with no permit at the back of the house, by the kitchen. The neighbor complained and the violation from 2016 is still active with DoB. The previous owner paid an $800 fine in 2016.
Provided I get financing and I purchase the building, I think my options are:
1-tear down and file correction certificate.
2-Try legalize extension via architect/engineer etc.
3-Ignore the whole thing and keep the extension for the next 5-10 years and deal with it later. ( as previous owner did).
How much would it cost to correct this problem? Are we talking a few thousand , maybe $10-20K, more? Any advice from someone who went through similar issues, would be very appreciated.

Good agents do know wonderful people in their network to help with any situation. However, always use an independent attorney. It’s a conflict of interest, and there have been sad legal cases in Brooklyn of agent and attorney conspiring to defraud buyers.

If realtor is sellers agent, lawyer may be focused on getting deal done rather than representing buyers interest (which may end up being not completing transaction)

@cate why not work with an attny referred by the agent? Depending on the agent, their referral is usually based on successful transactions, and typically are familiar with the area. If this is a solid agent with a solid track record I’d go with their recommendation. As for the violation, a bank may not loan until it’s cleared up. Legalizing the extension will be an issue if there’s less than 30′ of the backyard from the property line to building.

Whatever you do, make sure you have an attorney (recommended by a friend, not the realtor). They deal with escrow and issues like this. $5K is nothing but in this market some buyers may overlook.

We had a sidewalk violation discovered during the title search. Seller wanted to escrow some funds or give us a credit to pay for the work. It was a different market then, but we insisted that if the seller wanted to close, he needed to cure the violation. He did and we closed.

You should ask your inspector or architect/contractor what they estimate it will cost to cure the violation and make the necessary repairs or demolish. There is no way $5000 covers that in Brooklyn.

First ask your Mortgage Banker / Broker if you can even get financing with the violation. Banks change what they will & will not accept all the time. How old is the extension? I have seen cases where a neighbor maliciously complained about one thing & a DOB inspector filed a violation for something else, without properly checking their own records as to when the “extension” was built. Tea porches built in the early 1900’s are typical; Grandfathered in & built before C of O’s were even needed. Recently restored, can look like newly built.

Too many unknowns to comment on this. Is the property landmarked, location, lot size etc are all going to need to be factored in. Best to contact an architect or expediter. They can look up your building and advise.
