Brownstone Landmark "Second" Floor Deck?

This is definitely doable and should not be an issue with LPC assuming it wouldn’t be visible. You should also consider engaging with an engineer as this is often more of an engineering challenge than an architectural one (steel c-channels, steel posts, concrete footings, etc.)
I have worked on a number of rear yard decks in Brooklyn and I am currently working on one in Bed-Stuy now.
Would you consider a design-build firm? They can provide accurate pricing before you submit to LPC/DOB. This also helps to simplify the process for you with only one point of contact.

We’ve done tons of these. In most cases, LPC is ok with decks. If they can’t be seen from the street, then it’s practically a no-brainer. Even if it is visible, it’s probably an easy pass, but you may need to present it to the commissioners just because the staff may not be allowed to approve it because it’s visible from the street.

But the original poster is asking for a deck on the floor ABOVE the parlor floor, right? So he is not “ok”.
BTW this is a silly rule and every other city allows decks with stairs from higher floors. Commonplace in SF and Chicago!

I have used examples from neighboring buildings for LPC submissions where something is visible from the street (pergolas, fences etc). I’ve never submitted an application to LPC for a deck like this but as it;s likely not visible from the street it should be one of the more straight forward parts of your application.

To add to EJR’s post, a deck can have steps to the ground only if it’s on the first floor above grade. This may be the parlor floor only if the garden level is below grade (in the front) making it a basement. If the garden level is not below grade, then it is a first floor, and the floor above it would be a second floor. Steps from the second floor are not allowed.
Chances are that because you mention a landmark brownstone, the garden floor is a basement and the parlor floor is the first floor, in which case you’re ok. Just make sure before you take it any further.

I am doing a full gut renovation on the house and its a historical landmark, I need approval from the landmark department before I can proceeded with the deck. I’ve heard that others in the area that have done it so I was hoping that it would help my request to provide back up documentation to the landmarks commission.

Why is LPC involved if it’s in your yard? And why would proof of one in existence somewhere else matter? Have you already received input from the LPC on it?
