Boiler Inspections

I recently was notified by the DOB that for 2014 I had no boiler inspection filed and that I needed to send a copy of the inspection and the cancelled check from the filing to the city. I have a copy of the inspection report from my heating/plumbing company but they are unable to find a cancelled check! this means I am subject to a $1000. fine. I feel I am at the mercy of my heating/plumbing people here and I fear this won’ t be the last year the city will be coming after me for this. Has anyone else had experience with this problem?

I have never know a plumber willing to send in the completed inspection form & check. All the plumbers that I have used over the years have done the inspection, filled in, signed and sealed their sections. Then send it to me with the instructions for my signature, the check and the instructions to send it certified mail with return receipt as proof of filing.
In the past 10 years or so, I have received notice of non receipt from the City a couple of times, but because of the certified mail and proof of payment, I have had it waived. Waste of my time, but the City is notoriously not reliable in their record keeping.

They can’t find the check because they clearly didn’t file the inspection, even though it was completed. Unfortunately I don’t see any way you’re getting out of the fine. I would definitely contact a higher-up in the company and explain to them that unless they can provide you with documentation that the inspection was filed and the fee was paid they are responsible for the fine. That may or may not work. As for your concern that other inspections may not have been filed, check the DOB BIS system (http://a810-bisweb.nyc.gov/bisweb/bispi00.jsp). Click on “Violations-DOB” to see if there are any other boiler violations on your property.

FYI to responders thanks, the boiler company pays that filing fee, which in fact, I did not even KNOW was required. I only found this out, when i got the fine. Then, back to them, they sent me various reports they had never sent me, realizing the situation, I insisted they find the check, and they simply can’t! Obviously they need to be fired. That’s the next step. In the meantime hope beyond hope the city does not levy that $1000 fine in me for an error of $30. !

Typically the boiler company sends you the after inspection form and you sign it then mail it with the check to DOB before the end of the year

Whoever paid has a check. It might be you boiler company. Check your bill.
If boiler company paid the fee, they would reflect it in the bill.

Your boiler company would not have the cancelled check. You should. If you don’t have the check, get its number from your checkbook register and contact your bank. They can provide you with a photo (or electronic) copy of the check.
