Bed Bug Disclosures, Now Yearly

NYC will be requiring all managing agents / owners to compile yearly information on each apartment (the first is between 11/17 and 11/18), compile that data and then send to NYC in December 2018. Welcome to Local Law 69 of 2017.

Once it is compiled, it will also need to be posted in a prominent place in the building, so that all residents and visitors can see the report that was filed (and a confirmation that it was filed).

In the past, disclosure forms were used only on a transactional basis and largely kept private. We were required to notify if any bed bug infestations had taken place on the floor or in the building in the past year, but those disclosures were kept at the closing. The new law will require that we release that information once it is submitted from all tenants.

Look out for this questionnaire form in 2018 if you reside in NYC. If you own properties in NYC, now is the time to start compiling that data to be sent in 2018 to New York City.
