Basement garden level apartment as living space

Hi, I’m interested in renovating the garden level which is a basement (not a cellar) of a single-family house, to include the kitchen as well as a full bathroom. DOB info is a bit unclear – suggests if certain conditions re ventilation and protecting against dampness are met, should be ok. Anyone know what the rules would be?

Best to consult an architect, even if the light & air as well as the floor ratio’s are all within limits in your zoning, a kitchen & additional bathroom with be a change of use to a two family. Even if the architect says “yes it can be done” , be careful of the huge increase in Real Estate taxes a couple of years after you get your new C of O.
