Backyard next door - fence removal

Hi, just wondering about protocol – we have new owners next door who are planning a lavish full reno of their backyard (ours is a giant tree and a pile of dirt, as we’re saving up for an eventual – less lavish – renovation). We have a chain link fence around our backyard, marking the property line. New neighbors asked if they could remove it on their side, to put up their new cedar fencing. Is there a reason to say yes or no to this? My feeling is that property lines are important, and essentially saying yes would mean losing some of our backyard to their fence posts, but I don’t want to be a jerk!

Ok, last one from me (i hope!) – the neighbors told me that they hired professional surveyors, who apparently came out yesterday – but they didn’t mark/stake the line or anything. Neighbors said they will “send documentation” from them in a few days (we’ll be out of the country), but am I right in thinking that’s weird? How can the contractor know what’s what if there is not physical evidence of the property line?

You can certainly hire the surveyor for your entire lot and ask the neighbor to share in the cost of surveying the line you share. Just trying to offer alternatives for your negotiation

you guys! thank you! i’m actually going to offer to go halves on a surveyor, because the neighbor’s going to pay for the whole fence, etc., and it’s worth it to me to make sure it’s done right. any suggestions on where to find a surveyor, so i know it’s legit?

When our neighbor put in a fence years ago, I had to stand outside and tell the contractor to move the string, as he was clearly going to put the posts on our side of the property line. I was just eyeballing it, looking at where our attached houses met, and saw they would wind up on our property. He was annoyed but moved the string. Definitely pay attention to what they’re doing that day if you don’t get a survey.

They either put stakes into the ground, or cut a cross into any solid object thats by the property line. These stakes/crosses are outlined on the survey drawing. Make sure you get a copy and also take pictures. Worse case, if they do build the fence on your property, there’s nothing stopping you from taking a saw and cutting it down, so it’s in their interest to get it right.

thanks all! i think we’re going to ask that they get a real survey if they want to touch our fence, and that they sink their posts on their side of the line. i think they’ll do it, because they seem to REALLY want to get rid of their fence (it seems like it interferes with their grand vision)! but here’s kind of a dumb question: how do i make sure they abide by the survey? presuming a surveyor will put down stakes on the line, but we’re going to be away, and couldn’t their contractor just pull the stakes and do whatever they want? ugh, what a headache. thanks so much for being so amazing, everybody!

A survey seems like a lot to ask of your new neighbor, but I cannot state this strongly enough–request it! We have had two properties surveyed, and both times our property was shorted by the existing fencing.

I am sure you can politely say that any changes are conditional on a survey being done – it’s very reasonable to want everything above board. Are they asking you to contribute towards the cost of the fence or the removal of yours? Some folks expect you to contribute to their fancy upgrades which is frustrating. Are you and your neighbor prepared to deal with the weeds and mosquitos that come with back-to-back fences? We have a neighbor who made a ‘fence’ out of random sticks and their whole backyard was perpetually unkempt – how about we trade?

If they are sinking posts, they need to do a real survey… You don’t want to create an adversarial relationship, but this is an entirely reasonable ask on your part. I was shocked (as was my neighbor) at how far off the old chain link fences were in our backyards, clearly someone years ago just eyeballed it. New fence looks great!

Protect yourselves! Talk to an attorney, find out about potential liability, and have the attorney write them a letter stating your position. If you don’t know a real estate attorney who can do this, then you can get a consultation with one with the right experience for your issue for free or really cheap ($35) by contacting the nyc bar association (check their website) and getting a referral to a lawyer based on your issue. It will cost you some to have the letter sent, but it will be worth it – real estate people tend to listen when a lawyer gets involved. (And you are right to believe they will likely be selling the place if they are real estate people.). And yes, you can do this before you leave, if you want to consult an attorney in person – attorneys are used to working fast – but you need to get on it today due to the holiday taking up the latter part of the week. (You can also do it after you leave by telephone, but it sounds like you need to get sta rted in any event.). And have someone check on the state of your backyard at least weekly for you while you are gone.

If they are new owners I’m wondering why they don’t have a recent survey handy?

If you like your fence and want to keep your fence, by all means don’t feel pressured. Just politely decline their proposal — it’s your property. The tin foil hat wearer in me would suggest keeping an eye on your yard cameras while you’re away or have a neighbor watch in case they want to act now and beg forgiveness later — though it doesn’t seem like they’d beg forgiveness!

God the saga continues! We told the neighbors that we would consider removing the fence if they were sure that they built the new one entirely on their side of the property line (we don’t want to have any ambiguity about who’s responsible) – but they don’t seem willing to get a real surveyor out (they don’t seem to be willing to do things by the book)! So we said no dice, we’re not having our fence ripped out with the possibility that we are getting something built on our property that we’ll be liable for if anyone sells (the new neighbors are in real estate, so….). Now they’re being really passive aggressive about it, saying that their contractor wants the fence gone, and that theirs will look much better, etc etc (these people have literally just moved in, and are chucking a bunch of money to make their backyard look like some kind of magazine spread). At this point, we’re leaving for the summer next week, and even if they say they’ll do it “properly” it’s still a headache to imagine them ripping stuff out of our backyard while we’re away. We just want to take our time and figure out what we want to do with our yard! We love our little ivy-covered fence! Agh!

There are a few questions you should ask yourself: Is this going to impinge on the space or usage of your back yard? Will it have a positive or negative impact on the value of your home? Are they asking you to contribute towards the cost or are you essentially getting a new fence for free?
If it’s not going to take up your space, it looks nice and the cost isn’t too high you should jump at this opportunity!

For what it’s worth, I 100% second Cate’s suggestion to avoid back-to-back fences if possible. We have that with our neighbors, and there is a veritable JUNGLE growing between the two fences. I don’t even know how it’s possible for that much japanese knotweed to sprout within a three-inch space!

Thanks all – I am just concerned that if they build the fence right on our property line, so it’s “ours” as well, that means we will end up being responsible for it (if, for example, they ever sell). Part of me feels like it would be easier to just keep things separate…

Be glad that they asked. Remove the fence, survey the boundary, and put the posts for the cedar fence pub the propriety line. Then you’ll have posts to use when you do your renovation.
