Backyard Fence/ Neighbor dispute
My neighbor took down the fence that separates our connecting backyards. There was a 6″ gap between our fence and their fence and they are planning to encroach into this area and put it right next to our fence. First, I have a land surveyor who will get the correct dimensions of our property. But after that, I want to put a new fence (under 6 feet tall) to replace our fence. What’s the process for putting in that new fence? Do I need a permit? Any recommendations for Brooklyn contractors that specialize in putting up fences. I want to put that fence correctly on the border. Thanks.

Where is the legal requirement that someone must install finish side out? I think there have been numerous threads about that on this site over the years, with the eventual consensus being “it is polite to do so, but isn’t required in NYC.” Personally I like the “non-finish” side better anyway. Allows me to climb over and escape when be chased by raccoons.

Technically, your neighbor is required to install a fence with the finish side facing out. I agree that a discussion may result in a collaboration that gives you both a beautiful ecological solution. There are several designs that would work, shadow box is very nice (horizontal or vertical) and it allows air to flow through, minimizing mosquito populations. Why not just measure up your plot lines and then make sure the neighbor has his fence on the correct line, then enjoy his new fence! No need for you to put a fence up. It is actually annoying to have weeds and stuff grow between 2 wooden fences because neither of us can remove the weeds (which grow up and harbor mosquitos in the summer).
