B1 Two Family with three units?

Hi, I’m looking at a building that is classed as a B1 Two Family but currently has three apartments. There is no CO but the ICard and HPD both show three apartments. DOF says it has two apartments. Do you think this is a legal three apt rental?

Legal 3 for sure. DOF classification doesn’t mean anything – legal use is determined by HPD and/or iCard. DO NOT try and change the class with DOF.. your taxes will go up.

If both the iCard and HPD list it as a 3 family and there is no CO, then it is legally a 3 family. I think it would be best if you applied for a Letter of No Objection for use as a 3 in case the bank or your insurer asks. Others may have a different view. Hopefully you will get more responses.
