architect - do you have to keep working with one after the plans are approved?

I have a terrible architect. but the plans are almost approved. once it is approved I don’t want to ever work with him again. but, is that possible or would I have to throughout the construction process? this is for new construction, small project (one regular size lot), commercial.

It is possible for an a registered professional (IE: Registered Architect, Landscape Architect, or Professional Engineer) to supercede the application and close it out themselves. Jorge has a point about the copyright, but typically the original architect would be more than happy to have someone else worry about the sign-off. This part is becoming more burdensome for owners and professionals alike as the DOB is transitioning.

I’m not really on bad terms with the architect, I’m just upset at him for dragging it on for 2.5 years when he initially told me a few months. I’m considering finishing the project with him, it’s just that since he dragged on making the plans for 2.5 years I’m afraid he’ll drag on the construction as well and that’s much worse than taking his time making the drawings.
The lot is about 2,000 SQFT ~20’ x ~100’. 1 floor warehouse with a ¼ of the length a mezzanine floor for office, and a full basement. Just a square box, plain warehouse. In Bushwick. Initially 2 architects told me 30K, and he said 15K. I already paid him 10k, so just 5 remains which I’ll pay him when the plans are approved.

Slopefarm is correct. You want to make these decisions BEFORE getting the job approved. The sooner you address it the more options you have.

Jorge’s comment gets at what was bothering me, here. Why file an architect’s plans if you know that the architect is not going to see it through to closing the job. You could get stuck in a bad limbo here. I do not know all the rules that apply, but I strongly suggest you figure out who IS going to be responsible for the job going forward and who will be getting you to sign off and you follow THAT person’s lead on whether to file/use etc the plans of the architect you want to fire.

The superseding architect cannot legally use the intellectual property of the original architect, without the original architects consent. Unless otherwise indicated in your contract the approved drawings are property of the original architect. You do not own the drawings the architect does. In the State of New York an architect does not even have to copyright there drawings it is automatically considered copyrighted by law the moment the architect does the drawing. You have no authority to use his drawings in a manner he does not approve of. You will be liable for copyright infringement if you supersede an architect without his consent and use his drawings. Otherwise the new architect would have to reproduce the drawings causing more work. But if he reproduces the drawings based on the other architects drawings once again copyright laws are violated. Another option is the new architect redesigns the building. Cheapest easiest option is get in writing from the or iginal architect that he gives you rights to the intellectual property and the new architect as well. Then the new architect can use his drawings switch the name stamp and he is good.

You can get another service architect superseding the current one after filing. If you have a capable expediter you can has him/her for advice.
You just need him to be on file and sign off. Expect to pay at least 10k even if you never even see the guy. In the end the architect on file is the one liable and that doesn’t come for free.

Also be careful if you fire him on bad terms without hiring another architect he can withdraw his license and stop the job, your permit will be useless. Also if you fire an architect all he has to do is write a letter to the DOB and you will get a stop work order on your project.

The Architect is needed throughout the entire job until you get signoff. You will NOT be able to get signoff without the architect. You will NOT get a Certificate of occupancy. Paying 15,000- 30,000 for new construction is ABSURDLY LOW even for a small project. I am very serious that is crazy low. How many square feet is it? What type of building? Please be concerned as to weather or not this is even being done properly and if everything you need is included.
Don’t listen to bad advice, if anyone says you do not need the architect after approvals that is just evidence that they do not understand the process of making a building and obtaining a certificate of occupancy in NYC. At minimum you need the architect because the architect is required to do progress inspections and submit Technical Reports to DOB. You may need other things too I do not know what type of building it is.
You can replace an architect on a job . This can be easy or complicated depending on th e original architect and several factors.

the current architect is going to get the plans approved. that’s the agreement and it seems like it’s almost there. so he will be the architect of record. so the question is if I’ll need him after the plans are approved. meaning is it common during construction to make changes that will require him to change the plans? and does an architect needs to sign off on a job after the construction is finished? or is the architect’s job is mostly to get the plans approved and after that I won’t really need him?

Question is who is going to file. You dont want someone you are about to fire to be architect of record. Otoh, new guy might not want to file someone else’s plans. Get new guy in place and figure out how you want to proceed, then work out termination as amicably as you can.

are you willing to pay him the full 15k? If so, part ways and find a new architect. What you probably need at that stage is less of an architect per se, but a project manager to ensure everything is running smoothly and the plans are being properly implemented by the GC/trades.

I was foolish. hand shake deal, no contract. when I bought the land he had already started working on the plans with previous owner so it was cheaper to just continue with him. that was 2.5 years ago. he dragged it on forever. we agreed on 15k for him to finish the plans and get them approved (2 other architects quoted 30k). but I suspect once it will be approved, if I’ll need him farther he’ll ask for much more. and I’m afraid other architects won’t be willing to finish someone else’s work.
