Alt1 renovation or New building

We have a building site nearby where the developer has filed for an Alt1 renovation. The job description is “proposed 2 story addition to existing 2-story brick building”. Yet they have demolished the entire building except for the first floor perimeter walls which appear to be non-structural.
At what point is an alt1 renovation scope so large that it should actually be a filed as a new building?
If for instance, they demolish the entire building except for the foundation, is it still an alt1 renovation?

We’ve also seen situations where the DOB required a NB filing when the extent of demolition exceeds 50% of the existing structure. In these cases, they can insist that the whole existing building be removed, including the foundation. In one case, we wanted to reuse the foundation and had to file a request for a waiver of demolition to keep the foundation.

A new building is 100% new with NOTHING from the original building.
Then there is ALT 1 for new building (NB) requirements. That is when you increase by 110% more square feet than the original building. Meaning you are adding an extra 110% sf. That is an alt 1 but you would be required to follow all NB regulations.
Then a regular Alt 1 is for any building change requiring a new Certificate of Occupancy that is not required to follow NB regulations.

“NB” cannot be selected if any existing building elements are to remain—for example a part of an old foundation, a portion of a façade that will be incorporated into the construction, etc.”

I would hope an architect or builder chimes in here, as the rules are tricky, but I’m sure that there are ways that you can even demolish the foundation and still file as an Alteration.
