Allowing BBQ / Grill on tenant deck?

We have a two-family brownstone, and the upstairs rental has a deck which is right above our bedroom (on top of our extension). We are wondering whether to allow an outdoor grill on it; I’m very uncomfortable, but our broker suggests either propane or electric to be safe (no charcoal), which he’s seen in smaller buildings like ours. Anyone have thoughts on this?

I was forced to go with electric grills in two apartment buildings I lived in. They work perfectly good enough. It’s not a bad compromise and it’s a zillion times safer than open flames.

Its my understanding It is illegal to transport propane through a residential property. So a propane grill at the rear of an attached house, is de facto, illegal. And the BBQ within 10′ would seem to preclude unless its a really deep extension.

Regardless of the legality, I would never allow a tenant to have a grill above my dwelling unit. Does it really make that much of a difference in rent?

Also, what a rental broker “has seen” really isnt much to go on. Talk to Buildings or FDNY or ask your local council member to find out for you.

You cannot have a BBQ within 10′ of a residential building.
Thus any BBQ on a deck that is a part of the building is illegal.

I did not catch that it was a deck on top of an extension on initial read. This seems to make it a terrace, not a balcony and therefore seems legal. I would be less concerned by this. On the flip side, I would not want someone else to have deck access rights on what is essentially the roof of my bedroom, but that’s a separate issue.

I mean it’s a gas grill, not really a big deal in terms of safety.
If you allow extras that you have concerns about, make an additional rider to the contract with rules. For example ‘no storage of extra gas tanks inside or outside the building’ or ‘barbecue no more than twice a week’ and ‘must be placed on the most distant spot from the building’ or ‘maximum occupancy of deck is 8 people’ or whatever you like.
Then there is no discussion afterwards, because it’s agreed in the contract

Whether or not it’s legal probably depends on whether the “deck” is a terrace or a balcony. If a balcony then it’s illegal. If it’s a terrace then it may be legal. This sounds like a terrible idea and I would not let a tenant do it.

I’m confused about what is and isn’t legal here, but beyond that, a propane grill right above my bedroom would scare the sh*t out of me. Maybe an electric grill, IF there’s an adequate electric outlet?
