so this happened yesterday
“The New York City Council voted unanimously on Wednesday to significantly restrict Airbnb and other online home rental services, joining a growing movement of cities around the globe in stepping up regulation of the so-called sharing economy.

do people think this will lead to the city cracking down on AirBnB rentals in 1 and 2 family homes or will they focus on larger apartment buildings that are operating as illegal hotels?

I think Airbnb rentals under 30 days are still legal for 1 and 2 family homes. The under 30 rule only applies to the Multiple Dwellings which is 3 family and above. Though I’m not sure if it applies to 2 family non-owner occupied rental properties as you’re technically suppose to file a Multiple Dwelling Registration with HPD if its full rental.

Well, in the article it says “City officials said the bill focused primarily on large-scale commercial landlords who were gaming the system.”
I am absolutely certain after they have solved the problem with commercial landlords, the city will disband this unit and not focus on smaller fish.
As a “smaller fish” and as someone who almost exclusively uses AirBnb when I travel with my family, I’m biased in favor of it. Not that I don’t see the potential for abuse, and indeed I’ve actually rented places that turned out to be hotel rooms basically (I’m not sure what the local laws in those cities were).
The people we have staying in our unit are almost exclusively grandparents coming to see their kids and new grandkids, and maybe a few people for weddings. They are quiet, polite, and visit a lot of local businesses. We own and live in our building, so hopefully we’re not on the city’s targeted list. The apartment we rent has never been on the market, and its not strictly up to code to qualify as a rental apartment (some minor stuff).

Yeah, I think the better solution is to allow 2-fam and maybe 3-fam owner-occupieds to do this with their rental and focus on shutting down more quasi- hotel type uses. A real B&B should register and be regulated as such.

I am torn on this.
Pro Airbnb:
1) I have used Airbnb with generally very positive results.
2) I often think that the city is overly meddlesome and imposes unnecessary hurdles and restrictions.
3) I cannot see that Airbnb has enough units to truly affect that affordability of housing in NYC.
4) The cynical action of the hotel lobby seems like a bad way to make public policy.
Anti-Airbnb:
1) Transient renters change the character of a building and neighborhood for the worse. I would rather have neighbors who care about the block, pick up their trash, look out for each other, treat their neighbors with respect, etc. I once lived in a condo building in Manhattan that had many corporate-owned apartments used by those companies for short term stay for out of town employees. It had a serious impact on the building–both value and character. This is one reason for zoning–so that residential neighborhoods are not disrupted by commercial activity.
2) There is a major question of liability, not just for the renter, but also for neighbors. What happens if a renter sets the apartment on fire and it spreads to your home but the owner’s insurance company does not cover the loss since it was being used as a hotel?
3) I do agree with the hotel lobby that it is unfair that hotels have to charge hotel taxes, but airbnb does not. It is unfair to hotels, but it is also unfair to NY residents who have to pick up the difference through higher property and income taxes.

Or maybe airbnb’s aspirational (at best), explicit assertion that the mere presence of Airbnb units in black and brown neighborhoods will drive additional traffic to local businesses in those neighborhoods (and that cities should welcome them with open arms as a result) has been shown by at least one actual research study (as opposed to opinion and conjecture) to be demonstrably false.

Airbnb only helps local restaurants and businesses in “select” neighborhoods. Other neighborhoods are just used a cheap crash pads

While I understand how AirBnB can indeed bring tourists into new neighborhoods, and that can be fun for them, and perhaps beneficial to some local merchants, I think it is very worrisome that “starter apartments” are being taken out of the long-term market. I’d prefer to live on a street which is inhabited by people who live there full-time, etc. I think a policy should still allow for sub-30 day apartment rentals by resident owners or renters, but only for a limited number of days per year.

I think AirBnB allows people to visit NYC for a longer period of time because it is a fraction of the cost of a hotel, and for families traveling with kids having a kitchen is a huge plus, and as no permitz says these longer stays in neighborhoods in brooklyn that would not otherwise get tourists brings many benefits to local restaurants, bars, coffee shops, grocery stores, etc.

Putnam, but what about all the benefits for those neighborhoods and local businesses? I think the pros outweigh the cons.

Unfortunately about 3 or 4 neighbors have converted what were long-term ground floor apartments into AirBnB businesses. I think it is a shame for both long-term residents of my neighborhood and younger folks trying to make it in NYC to lose those kinds of housing.
