Airbnb rules on a 3 family

Hello Brownstoner,
We have a 3 family home with one vacant apartment and were kicking around the idea of renting one of the units as a short term rental. We occupy the parlor ground and finished cellar and have a tenant on the top floor. The middle floor is currently empty. I came across this article

and wanted to know the forums opinion. The way I read this law, it states that if 3 or more families reside in the residence. The house is a legal 3 but only 2 of the units are occupied. My questions are as follows :

1. Can I rent out both apartments Airbnb for short term rental if the top floor tenants ended up leaving eventually?

2. What if we kept the top floor permanent tenants and rented our middle floor as a short term rental and we occupied our 3 lower floors permanently? Is this allowed?

3. If anyone has rented Airbnb, how do you like it and what would you say the average occupancy rate is throughout the year in Bed Stuy?

If signed into law. the bill is a ban on advertising where the short-term rental would be prohibited by law. The bill does not alter the underlying law as to what short-term rentals are legal vs illegal. Nor would it alter the insurance risk as discussed above.

Just received this email today from Airbnb

Wow. Thank you! You and thousands of other Airbnb supporters across New York state stepped up to the plate. You emailed, you tweeted, and you called your legislators. Our message was heard loud and clear — we aren’t going to just sit silently and take it when the hotel lobby comes after our community.

Here’s a bigger issue than whatever’s legal w/ the city: When your Air BnB tenant accidently sets the house on fire – or when there’s a freak accident and someone gets injured or worse on your property, you’ll be completely SOL. Your insurance won’t cover you for damage, liability or lawsuits resulting from a short-term tenant, legal or not. Is it really worth it to lose your house and go bankrupt over a low-gain, short-term weekend rental to some tourist from LA?

The AG report focuses on the rental of an “entire/home apartment” for less than 30 days. If you restricted/closed off certain portions of the apartment, wouldn’t that circumvent the ‘violation’. For example, my units are 1.5 bedroom floor thrus. If I keep the half room locked(because it has my personal items inside), would that still be an ‘illegal’ rental?

Right, I think we all understand that. You can rent out a room in your apartment where you live while you live there. the discussion here is about the legality of renting out a vacant apartment in a house you own short-term through airbnb. For that, as many hve pointed out, the alw seems to be that your c/o needs to expressly allow that use.

It is not necessarily illegal to have an AIR BnB in your primary residence, there appears to be a distinction carved out for short term rentals of private rooms in that a private room rented for less than 30 days is legal only where a permanent resident was present during the stay. Right. it is an unwieldy city. Big gap between what is legal and what is actually enforced. City, state AG, etc more likely to go after the big airbnb “hotels” than 3-fam owner occupied houses.

Also there is the hotel occupancy tax / sales tax issue. If you get caught avoiding those taxes that could also be a serious penalty.

I think Eileen says it pretty succinctly. You need to have a certificate of occupancy allowing hotel use in order to legally operate a hotel. Doesn’t matter whether you have a 2 family or a 3 family or more – it needs to have a hotel C of O if you want to rent a unit on Airbnb. Of course you could probably do it and get away with it, but the penalties might be pretty severe if the city cracks down.

Dorys: did you read any of the above comments. It is not legal to have transient tenants unless you have a Certificate of Occupancy for such use; and are operating as a hotel or short stay business.
