311 harassment with fake complaints
Anybody who has experienced the same below, please share with me.
Somebody has been making more than 90 fake complaints about our house. No hot water, or bed bugs or use of drill etc.. All untrue. The house is empty and we have been waiting for a permit. HPD and DOB refuse to help us, and 311 says that they can’t flag the house and are forced to pass the complaints even anonymous ones. In the case of HPD, every pending (and fake) complain is followed by robocalls to my number (sometimes in 6 calls in a row on Sunday mornings very early) The person making the allegations has been using the name of my neighbor and some other number of a man in Miami, but both denied making the complaints. Police refuses to file a report for second-degree harassment because the harassment they say is not direct to me and not threatening to my life. It nevertheless stigmatized my property should I want to sell it. Who wants to buy a house with a crazy man targeting the home. Also by the end of the year at this rate, the house will have 500 complains recorded and likely some violations as a result (law of numbers). I know that after Sandy many residents in Staten Island were victims of similar harassment with 311. A guy at the DOB told me that it sounded like organized harassment by developers. I find 311 very useful, but in that instance, I think they should not allow this form of institutional harassment. Our councilman cannot help us. The inspector general tried to help us with HPD but no result so far. The supervisors at 311 are not able to help us either.

I am not sure but an attorney maybe able to put in a FOIL request to see who made the complaints. You can also call your local representative and they should be able to give you the information for your Community NYPD contact.

When you followed up with the complaint numbers, what were the outcomes stated?
Giving the owners violations is not something that is posted on the outside of the property.

Considering I’ve called 311 about 20 times on a neighboring property (a slum/fleapit/squat for about 20 random people that change every month) for REAL violations and not a single thing has happened I don’t know what you are worrying about. 311 is a joke.

The house has problems so whoever does it knows it and is maybe trying to push us to sell. Or if it’s somebody with a beef then 311 should be here to help protect and serve citizens, not to be used as a tool for people with a beef to harass others at will. if it becomes a tool to harass law abiding citizens then it’s very dangerous and should be illegal. Especially when complaints are followed to illegal robocalls at your home at 630 am on a Sunday morning.

It’s not a developer/flipper that’s doing this to you.
If you were an old owner, maybe not aware of the market, I might believe it. Or some other situation where they are trying to wear an owner down, or overwhelm them, but not with a recent purchaser. What would they gain to harass someone who probably paid close to market price? What’s the opportunity for them?
If you know you have complaints, you must know how to use the city websites. Check out neighboring buildings. If they don’t have any complaints, someone has beef with you.
Be very friendly with everyone, let them know if there are any problems with the building or anything else to contact you directly.

through 311 makes it easy because they don’t even have to write letters or knock on doors to pressure anybody. they don’t have to give their name or contact. They’ll put 1000 complains over a year (law of numbers will turn that into 10% violations). Then they’ll write a letter to buy the property. It’s happening in east new york now.

No, I don’t think developers conspire in that sense. They no doubt harass, but that’s with letters, knocking on doors and phone calls.

Those letters are just from buying access to HPD so they get a list of all new violations or complaints like a cold call.
Kinda like how you automatically get letters from traffic lawyers when you get a moving violation

soundhoner you might be right, it could be a contractor also or a crooked expediter. got two letters from violation removal inc from queens mentioning problems on our building. . could be them. i don’t know. i just think this 311 abuse has to stop. too easy!

I know who the complainer is, it’s an elderly tenant whom I inherited when I purchased the property.
It’s just what they do.
Their entitlement gets narrowed and this is the result of them acting like they own the place getting curtailed.
311 gets the city to be a free, proxy harasser on their behalf with one quick phone call.

In my block, for years, someone was doing 311 complaints on every house in the street (in Bed Stuy) for sidewalk violations. The City was very happy to issue these. Then, magically a contractor would turn up and request payment to repair it (a ‘city contractor’). This happened before I purchased my home, which had a violation on it. Well, one day I had the pavement completely redone (and a city contractor did it because they installed a garden/drainage thing in the front). Within one week, I happened to be home and caught a crooked contractor with a handsaw creating a C-shaped crack in my sidewalk (I posted a Brownstoner post about it and went to the cops among other things).
Yes, there are crooked contractors. Very unlikely to be a developer. If you’re a developer and want to somehow obtain someone’s property cheaply, would you want a property with a litany of violations to cure?

Sometimes it’s contractors looking to get work “correcting” violations. Several years ago someone called in window complaints to the LPC for EVERY house on a block near mine, including some non-existent addresses that were skipped when address numbers were originally assigned.

Developers have better things to do and easier targets. It’s not some conspiracy or organized plot. You have any angry neighbor, or someone else who you beat out on the purchase. And if you do have a suspicion as to who it is, you are probably right. Saying to someone, “call me if there’s any problem, any issue” with a straight look in the eye will get the message across without accusing someone.
