How long to get a commercial C of O change - Alt-1 Application?

I have posted a longer version of this query in the DOB topic on the Forum. I am a potential tenant in a commercial space in Brooklyn with M1-1 zoning – and a C of O which is for a Cosmetics Manufacturing factory. (the C of O is from 1965 – the building is from 1910.) I want to rent this, and use it as a movement studio ? and there are some extensive but standard renovations ? plumbing, electric, walls and floors, and putting a few windows in the brick facade. The architect, in consultation with some expeditors says that we will need an Alt-1 permit ? changing the C of O ? because it is a change of use. (the current owner is not a cosmetics manufacturer ? that is left over from the previous owner.) A) Is it definite that we need to change the C of O? (I heard that there were exceptions for older buildings? B) What is the quickest we can expect to get this approved so we can start construction? C) What is the average time? D) Which expeditor do you recommend for this? E) What would be a reasonable fee? F) What use should we put? One expeditor said “office” – there is also a use 9 for Theatrical/Dance Studios Many thanks!!!

The M1-1 zoning allows for your use (use group 9), but you will still need to change the C of O to reflect the occupancy of the space. There is no shortcut around this and given the current state of the Brooklyn DOB I would allow a minimum of 6 months for your Alt-1 to be approved. You may also need to file for a Place of Assembly if you intend on hosting performances or larger classes. If you want to install showers a further DOB determination or possible appeal to the BSA may be required. Any competent expeditor can handle the paperwork, but you will find that fees vary from around $4K to over $20K depending on the firm. What you will be paying for is their capacity to properly vet the proposed conditions for zoning and code compliance, and their ability to quickly respond to plan examiner objections and develop strategies to overcome DOB hurdles.’ We are currently wrapping up a performing arts center in Bed-Stuy which involved many of the issues you are confronting.
