tenant and keys

We are finally able to replace all the cheap locks with high security locks. We are also fixing the door . I have chosen ASA locks and only the locksmith i got them from can duplicate it and I have to give permission. We have 2 tenants Apt 1 has a single person, apt 2 is a couple but leagally there is only one tenant in the second apt. I call the city they said I leagally have to give each leagal tenant 1 key plus an extra key. They can buy extra keys if they loose them. But here are my questions 1, can I restrict the # of keys (according to the city only tenants can have keys)???  2\. Apt 1  right now has made copies for all his teen kids (who live with the mother) his sister and friends, I do not want this endless key stuff. Can I keep it to just 2 legal keys? He has no cleaning lady or whatever. Also one of his kids is a mess arrests etc… can I really restric these keys. 3 the keys are expensive $15plus tax since I have to go to the locksmith to get the keys can I charge them for my time? $20 an hour? I just need to know what is legal?

Lack of keys will result in the door being left open or a broken lock. I would just charge them for the keys and call it a day. Do you think if they request keys and you refuse the kids aren’t going to come over to visit the parent? They are still going to be in the building, except now they have a reason to be pissed off at you. If the tennant and the kids are unacceptable to you just don’t renew their lease when it expires. I would be more concerned about how well they pay the rent.

this for the MAIN DOOR not an individual apt.So they can not place their own lock in the main door The tenant with the “kids” 17-25 year olds DO NOT live in our building.  I dont want the druggy kid with the graffitti crazy gf to have keys to our house. They dont live there. I am suppose to give 1 per tenant and one extra. CAN I turn  down requests after those amounts. The gross kid vomited in the hall and left it.

do you mean ASSA ABLOY?  THE best.  I tried to get the ABLOY Protec but It was such a PITA so i went with Medeco Maxum, very happy with those as well.  No other dealer other than mine can make a copy –  I really like that.  And no one has ever picked / bumped that lock (yet). Anyway, sorry for the diversion.  I don’t have a legal answer ;( i would think each legal tenant who is an adult (including the allowed one roommate) should get their own key.  As far as children, they in fact are legal tenants so if the parents want them to have one – it seems reasonable, but as far as the letter of the law i’m not sure.  I wouldn’t want to get into a situation where the kid gets beat up or killed waiting for their parents who have the key, making you a certain target in a lawsuit if in fact they are allowed to have a key.  HAVING SAID THAT –    NYS Multiple Dewlling Law Sec. 51-c.     Rights of tenants to install and maintain locks in certain entrance doors. Every tenant of a multiple dwelling, except a tenant of a multiple dwelling under the supervision and control of a municipal housing authority, occupied by him, except as a hotel or motel, or college or school dormitory, shall have the right to install and maintain or cause to be installed and maintained in the entrance door of his particular housing unit in such multiple dwelling, a lock, separate and apart from any lock installed and maintained by the owner of such multiple dwelling, not more than three inches in circumference, as an ordinary incident to his tenancy, provided that a duplicate key to such lock shall be supplied to the landlord or his agent upon his request; and every provision of any lease hereafter made or entered into which reserves or provides for the payment by such tenant of any additional rent, bonus, fee or other charge or any other thing of value for the right or privilege of installing and/or maintaining any such lock, shall be deemed to be void as against public policy and wholly unenforceable. BASICALLY, they can install their own lock, give you a copy, and just not use yours, and you’ll be right back in the position you are now.  Sooooo….    Practically speaking i’d be generous with the keys for people who actually live there, in hope that they feel safe and never compelled to install their own lock that they are entitled to by law.
