Does anyone here know whether it’s possible to get a variance for the DOB’s 6′ maximum permitted fence height in residential areas?  A neighboring property (a former manufacturing facility turned residential rental development) has an existing masonry wall that far exceeds that 6′ height restriction.  All the neighbors along this wall have a strong interest in maintaing the status quo given the huge benefits it provides in terms of our privacy, security and property value.  The developer, understandably, just wants to finish his project and get it rented, but contractually agreed to maintain the wall as-is when he purchased air rights from neighboring properties several years ago.  Does anyone know whether application for a variance has any probability of approval here? Thanks in advance for any input!

You can put a taller structural wall in, they just need to pull a permit for it.  If you want to do a fence without a permit than you are limited to 6′ tall.
