Using 3-family as 2-family

Removing a kitchen will likely trigger a review of the current use, unless the building is already set up as a two family as far as floor separations and egress are concerned. You can definitely “just live in it” without any issues.

We are considering buying a 3-family townhouse to use as a 2-family (my husband and me, and our daughter and her family). The building is old and has no certificate of occupancy. I am told that if we apply for a new certificate, that will trigger an Alt-1 permit, with all sorts of difficult requirements (adding sprinklers, replacing water and sewer main from the street, do a builders pavement plan etc). We aren’t planning much in the way of changes. Can we just live in it as 2 families without changing anything with the city? If so, can we get rid of one kitchen or could that get us in trouble? Or can we file a “no works” permit to change the classification to 2-family? Are there tax ramifications?

I live in a 2 family and use it as 1. Don’t have a 2nd kitchen anymore. I had no trouble refinancing with the inspector. I left all the connections and capped them off.
Not sure what the difference would be with a 3 family since that’s considered a multiple dwelling but I would think you can

You can use a three-family as a two-family. But you cannot legally do the opposite.

Our house is a legal 3 (taxed as a 3) but used as a two family. There is no C of O. We had no issues with buying it and securing a mortgage. As Cate said, it’s only an issue if you are doing the opposite.

I think any additional account on the meter ( electrical, gas, etc. ), any additional kitchen is an issue. If you removing kitchen – no problem.

One thing to be aware of is that if you turn off a gas meter you may never be able to turn it back on again. It’s nothing to do with the laws around occupancy but because of other unrelated issues with gas service in NYC.
