Sprinklers required in 2-family?

Hi, I have a question about possibly changing the C of O. I have a 3-family that I’m using as a 2-family. The gas line inspection law 152 applies to 3-families and bigger, and frankly it seems like such a hassle that I’m thinking of having my C of O changed to a 2-family. But researching this, it seems that if a C of O change is made then some law kicks in that you need to install a sprinkler system? Is this true? I’m having trouble locating the correct information. Or are there other reasons to keep my 3-family status? Maybe this is just opening up a can of worms and I should just deal with the gas line inspection as much as I hate the red tape. Any insights would be greatly appreciated! Thanks!

Just to be sure. Does the building have an actual CO for a two family house? or is it without a CO, but listed as a 2 family with the Buildings Dept? I would guess that the response to your question might be different depending on the answer.

I am changing from a 3-family to a 2-family and I had to put in sprinklers. As mentioned above a new C of O will expose you to new standards (i.e. you lose your grandfathered status)

OK, that’s good to know. I actually did change the C of O years ago from 2-family to 3-family with no problems, because it was listed as a 2-family with the city even though the seller told me it was a legal 3-family and it was being used as a 3-family, and at that time it was very easy — an inspector came out and then changed it. But maybe I just got lucky? Or maybe things are different now? Do you know anyone who’s changed their C of O?

changing you CO is not an easy process and can open up your property to compliance with more recent code requirements that you were previously exempt from. if you hate red tape you DO NOT want to try to change your CO. the filings required for this would propel you to the deepest depths of DOB’s bureaucratic insanity.
