Properties classification change
Hi Maggie – i did the search and I printed out my property and my neighbor’s property – side by side. It’s representative of what the properties are now. Hopefully I will have nothing to worry about. Thanks for your help and everyone else who replied.

Does changing a properties classification from a B4 Family Dwelling to a C3-WALK-UP APARTMENT entitle the owner to more property? in 1989, my next door neighbor’s landlord converted his 2 family house to a 4 family house. This created an extension of the building in the back of the house. This summer, he fixed up the basement and is renting it out. The conversion is on the NYC DOP’s website, but the basement isn’t. I have a feeling that he will want to move the fences in front and back of the my house over in his favor. Is this possible? My family has owned my house since 1693. Thanks.

i’m confused by the question. are the fences currently on the property line? changing the occupancy of a property doesn’t change the size of the property. if you’re worried about him moving the fences you could get a survey of the property lines so you know whether any of the fences are not on the lines.

Just to clarify, and please dont’ be insulted, but your notion that someone can just move their property line is confusing.
I’m wondering if perhaps you had a conversation with this neighbor and misunderstood what they were talking about, or aren’t describing it fully here? The only thing I can think of is that if there is a fence that was constructed a long time ago that was actually on their property, making your property larger all these years, and now they’re hoping to correct that?
Otherwise, as mozeeatupu says, property lines are legal boundaries of ownership. No one gets to just take over their neighbor’s property (well, they can try, but they have no right to do so).

I’m not insulted – its speculation at this point. Resident2 advised on another question today that the property line is the middle of the party wall. My fence in front of the house is on my side of the party wall. However, there is a crack in the middle of the wall – don’t know if that would be an issue. When I spoke with the landlord a few months ago – he didn’t reference the property line – he referenced the bin#. So I thought at the time that if his bin# was bigger – he was entitled to more square feet. I’ll make another post if/when I am contacted about this. Thanks.

BIN is just Building. Identification Number, useful if there’s more than one building on a lot

The thing you need to look at isn’t the BIN# which, as mozeeatupu says is simply an identification number, but rather the definition of the tax lot that shows the physical outline of your property. Sounds like you don’t have anything to actually worry about at this point though… except for the crack in the middle of the party wall!

you can put your address in here: http://gis.nyc.gov/taxmap/map.htm and pull up the tax map that shows the outline of your property. As for whether the crack needs to be fixed I couldn’t tell you that just out of the blue because there are too many different types of crack but if you’re not having any water problems in your building you might still want to just keep an eye on it… like take a photo now and then watch it through the winter to see if it gets wider…
