Parking violation
It is a violation of zoning rules to park vehicles in the front. Do you have a curb cut and driveway or are you parking in the front yard?

I got a DOB violation for “parking in front of my house” as opposed to in the back… The whole block is doing that, not sure how we are different. And now that this is public record, starting to get letters from lawyers to hire them… Isn’t it better to get an expeditor who can research the history, the surveys, the filings, etc? Anybody can recommend expeditor who has done curb cut / parking pad type of work, especially fighting violations? Thanks in advance!

When you say “parking in front of my house” do you mean in your front garden/yard or on the street? If you mean in your front yard; that is considered a change of use; from a garden to a parking space. It also means that you did not get a building permit or a department of transport permit to create a curb cut or to permanently take away a public parking space on the public street.
If this is the case, that you do not have a “legal” use of your front yard for parking, you will NOT be able to legalese it as such. The City has banned this change of use. What your neighbors have done or do, does not make your violation go away. How do you know that they did not get a violation too? Or that maybe they legalized theirs before the City stopped allowing it? If you have legal parking in the rear, it is highly unlikely that you have legal parking in the front as well. Hire a lawyer to negotiate down the fine & hire a contractor to pull a permit correct the curb & fence etc.

Citation is for parking in front yard which is not allowed if my frontage is less than 35 feet. I I am using an existing easement/driveway/curb cut that has existed forever. It was meant for parking in the back. But that’s from the time when cars were smaller, nobody can fit between the houses any more. So yes, I am looking for lawyer recommendations.

Personally, I’d just let the violation sit. It’s such a minor citation that i doubt it’ll cause you any trouble down the road. (pun intended) The fine is what, few hundred dollars? Besides that fine, at the end of the day, they can’t make you do or not do anything regarding the parking. Once you get architects, expediters, contractors involved, it’s going to be thousands of dollars. I don’t even see a reasonable solution, if your car cant drive thru into the back, what do they expect you to do to remediate the violation, put a no parking sign out front?

Hey Anna, just saying we have the same narrow (maybe narrower) setup as you – at its widest I think we’re at 82” and narrowest it’s 80 – for at least 30 feet between homes.
It can be a pain to park in back but it IS possible and they make a lot of cars that fit – just takes a little practice and careful research when you buy a car. We got our 73” wide 1999 Ford Taurus wagon in and out of there for 4 years before we just got our Forester (71.5”wide, mirrors in).
Just make sure the mirrors fold in! Lol
Also if you have a shared drive you may be violating an easement agreement that says you can’t block the drive. Our old easement specifically bars doing anything that blocks vehicle access to the rear garages.

We just think of it this way: squeezing in and out of the drive is a pain but it sure beats looking for parking for two hours or risking the wrath of the DOB!
