It sounds like you will need to file to legalize the work and get a C of O issued.

I am about to purchase what I thought was a 2-family townhouse (in south slope), however it seems that the property card from the 50???s shows that the DOB categorized it as a 1-family (there is no C of O). I had the sellers apply for a ???Letter of No Objection??? as it is configured and used as a 2-family. However, it appears the application was rejected. ?? My question is simply: What happens next? Do we need to apply for a C of O? Does that mean we have to install sprinkler systems and fire escapes? It would seem very odd for a 2-family townhouse to have to do this.

Firstly;  go to DOB website and see why the LNO appl was rejected. If it was very recent, it may not be on the website yet. In that case, call Melanie Guzman at DOB (718) 802-3785; she is a pleasure to deal with. She will tell you why the appl was rejected and you can go from there. Any building built prior to 1938 by definition does not have a CofO. In your case the I card (property card) will prevail unless and until the building is issued a LNO for 2 family which will then supersede the I card. As it now stands as per your description, the building is a 1 family. DO NOT LET ANYONE TELL YOU DIFFERENTLY! Additionally the DOB is currently taking the position that buildings w/o a CofO (even those built prior to 1938) and having no I card or other info on file, are defaulting to 1 family status with the onus on the property owner to prove 2 family (such as LNO, etc.) I recently went through the LNO process as a private owner and it was daunting, yet do-able. Pro’s will charge about 1k. Good luck.

If all of that does not help, and for some reason you do have to change the CofO, it can be a daunting task.  But – it should not include sprinklers or fire escapes.  A two-family is interpreted just like a one-family for many aspects of the Building Code.
