Encroachment

Has anyone ever come to learn that your neighbor’s building is built on a slice (12 inches x 60 feet) of your property? If so, how did you proceed? I know consulting the survey, a lawyer, and the neighbor’s building plans are first steps, but I am wondering what some creative and/or amicable resolutions have been. Thanks!

thought i’d post an update, given the recent fence thread. the original owner sold to a builder, who intends to continue and finish renovations. must have been cash. the new owners have met with us and are submitting plans to remove the building from our property. that’s right – a wall that is 50′ long and 5 stories high, and about 12″ on our property. they didn’t even want to discuss alternative solutions. they’re building the new wall on the inside first, then removing the old wall. they have been friendly and cooperative. we are consulting experts to verify the work is consistent with the approved plans. and with a lawyer to write an appropriate access agreement, including escrow and insurance. on our way to a happy and amicable ending.

pursuing this issue currently. neighbor wants to sell, but has no c/o. i consulted with a lawyer and expediter. it was recommended that we compare original approved plans to a newly commissioned set of what is actually standing. then request the new neutral architect to determine compliance issues for both properties, given the encroachment. after/if DOB signs off, we settle on a monetary amount and combine 2 zones to 1\. if the DOB doesn’t sign off, then it seems neighbor is SOL, and will be forced to tear down. thoughts from all you experts are welcome and appreciated!

I am a little late to this discussion, but you should definitely consult an attorney. I think generally if the encroachment is less than 10 years old then there is no adverse possession. There were changes in the law in 2008, but if the encroachment pre-dates that like you say, I am not sure if they affect the status. Please update on what happens.

i’d contact a land use attorney like stuart a. klein or bob jacobs at bbwg to have them review. they will most likely tell you that it’s too late. they are both pricey.

The survey shows it. However, we have not yet seen the building plans, not for lack of trying. They seem to be missing. It’s possible, but not likely, that the DOB approved the his building dimensions without thoroughly studying.
