DOB Building Inspector Mistake
My tenant received a visit from the DOB building inspector the other day after a concerned citizen reported that there was no fire escape on my 3 family. None is required because I have sprinkler system installed, but the building inspector took the opportunity to issue 2 violation, one for illegal converson to a 3 family and another for building the partition that turned it into a 3 family. Trouble is the Certificate of Occupancy that he relied on to issue the violations was an old one. The later Certificate of Occupancy (which is on their website) says it superceeds the one he has put on his tickets and is for a 3 family. Its an honest mistake I guess and I would normally just turn up to the hearing but the trouble is that I live in Singapore. I have called them and the clerk agrees it is a mistake but hasn’t done anything to fix it and has now gone on holidays. Does anyone have any suggestions as to how I could handle this before the hearing so I don’t need to fly out?

I’ve seen cases where the new c/o says one thing, & the letter of no objection says another. Pull the letter of no objection first & start there.

Look at the cure date on the violation, just send it all of the paperwork to prove what you state before that date.

Don’t fly out. I had an ECB hearing and they wanted to know if I would show up. I did. So, they rescheduled the hearing and invited the other participants. That was a long time ago and I beat the rap without a lawyer, but several weeks went by between the first and second hearings.

1) Consult a lawyer, you can have someone represent you at the hearing. or: 2) You can send the Buildings Dep’t. and Environmental Control Board (who holds the hearings) all of the documentation and request that the violation be removed. The hearing will take place and you will lose by default, but with a little luck it will be rescinded after they get around to acting on the letter. Good luck.
