It will depend on your Condo Board. As most do not have the funds for all the petty rules many owners break, unless a neighbor decides to sue you, you may well be OK. I would still get a good liability policy in case one of your patients falls while in the building. Psychiatry is one of those home businesses that you can run out of an apartment, but I do think it is supposed to be a “home” business and depends on how many people you see each day etc.

We live in an apartment building and are considering opening a psychiatrist’s office in one of the units (would really cut our commute time!). The building’s CO is purely residential, however, and is on a residential street. We would use the unit only for the office, and live in a separate unit in the building. I’ve heard of CO violations with illegal apartments, but not with businesses in otherwise residential buildings. Usually with an illegal apartment, if the DOB finds out and issues a violation, the remedy is to remove the kitchen/bath and convert the space back to a non-apartment use. We’re not planning on ripping out the kitchen/bath in this unit, so technically it would still be a legal apartment — we’d just be running a business out of it. What are the potential consequences we could be facing if we get “caught”?

This basically a stupid idea. First of all, it’s very easy to get caught. All it takes is one neighbor to complain. Who owns the building? With the market so good for rentals, why would a landlord rent to you for an illegal use? It is the landlord that would be fined and required to correct (i.e. evict you).

This isn’t a rental building, its a condo. We own 2 units in the building.
