Permit required to replace existing deck with a 3-season room?

I am in a non-historic-district building with a back yard.  I am currently planning on replacing a 4-foot deck with a 3 season room that would extend about 8 feet back.  Zoning rules allow me to build that far back (ie. if I wanted to do a true extension, which this is not), but I’m not sure if a permit would be required, since I am planning a pretty sturdy construction, with windows, sliding glass door, tiled roof with skylights, etc. My contractor doesn’t think a permit is necessary (and i’d prefer to avoid the $3,000+ it would add to the project cost).  He does a lot of work in the area, so I trust his opinion – but I just want to be thorough and ask if anyone thinks differently.  I’d hate to get stopped mid-project. What is the best way to find out for certain? Thanks for any insight!

I researched a very similar situation: building a screen porch on our existing deck. It turned into a non-starter when my architect discovered that DOB would restrict the “windows” (ie. the area that could be screened) on the wall adjacent to my neighbor to 10% of the surface area of that wall. That would have blocked too much light and air so we abandoned the plan. But apparently it has to be a fire rated wall because DOB considered the screen porch to be an enlargement of the building’s envelope. I would assume the same would apply for a 3-season room.

Agreed with all previous posts. Any licensed contractor should know that you can’t build what you have described without plans and permits. Call an architect…Jock’s a good one to start with.

**Fire your contractor imediatelly** and find a new team. He is either liieing to you, or ignort of New York City regulations either way do not work with him. Best case scenario he is desperate for work and does not want to wait to have an architect do the design and documentation and then wait to get permits. Worst case scenario he doesn’t know what he is doing.

I would think the contractor is saying this as he is not licensed and so cannot pull the requried permit.

You should always take a contractor’s opinion with a grain of salt and do your own research first so you’ll know when he’s being up front with you.  You do need a permit since you’re adding square footage.

Of course you need a permit. You can’t build a garden shed more than 7′ tall without a permit in this town. You might want to make sure that deck is legit before you file too.

Yes, you are increasing the floor area of the building. Don’t listen to your contractor. He is not going to pay the fees when the project gets stopped.
