How To Stop or Minimize Impact of Neighboring House Being Demolished?

We have heard that the owner of the house next door to ours is interested in demolishing it (a detached Victorian, legal 2 family, zoned R5) and building an apartment block built in its place at some point during the next few months. We want to make sure we are prepared for any eventualities and are able to minimize any inconveniences during this process…….. – Is there anything we can do to prevent the house being demolished? It’s run down but not derelict and we’d much rather live next to another Victorian than an ugly new build. It’s not in an historic district. – What permits will the owner require to tear down the property? How can we check they have them? – What certification should the company doing the demolition have? How can we check they have them? – What precautions is the the demolition company obliged to take to prevent dust and debris spreading? The house is almost certainly full of lead paint and we want to minimize this getting into or onto our property. – Is there anything we should be doing during the demolition to minimize any negative impact? – Lastly, what permits are required to build an apartment block on the land, and how hard are these to get? Appreciate it.

Keep checking the address of the house on the Department of Buildings website to see what permits they have applied for. They can only demo if they have a demo permit and they have to post the permit at the job site. If they are doing work without a permit, you can call the DOB to report them. What precautions they must take re lead I do not know. Usually there is a big plywood fence up around a demo site, perhaps to contain the mess.

If this is a serious matter to you, the answers you get here may, at best, serve as a preliminary guide (and they might not all be correct) but you should really consult with an attorney who does RE, zoning, construction etc. Some of the questions you ask will have answers that vary depending on the specific circumstances — current zoning, proposed density, the details of the proposed plan and how close to the property line they propsoe to work, etc. etc.
