The provision that all floors above the 1st should have at least 80% of the area carpeted is a rule that is recorded on many of the co-op and condo by-laws. It is not a general code regulation or legal premise. We live in a condo that does NOT have this rule, yet the floor above us generates a lots of really annoying noise. Conversation and persuasion do not help 🙂 Does anyone know how the carpeting rule can be enforced? New York Building codes do not allow noise over 130 db, but how is this to be proved? what are the legal avenues? Anyone with a similar experience? I’d like to pick up your brains 🙂 before going to a lawyer

You can’t enforce anything that isn’t in your bylaws.  What a concept.  Get yourself on the condo board and see if you can get it added to the bylaws.  It probably can’t be enforced retroactively, but if you could get it on the bylaws then any future tentnats/owners would have to go by the rule. A lawyer isn’t going to help you enforce a rule that doesn’t exist though.  130 db is really loud – think skilsaw, chainsaw, firing a handgun, standing beside a jet engine plane while it is running, etc.  http://www.gcaudio.com/resources/howtos/loudness.html .

A bottle of wine and ask em to keep it down?  Dont know what your rapport is with your neighbor but wine might be a start, or apple pie if they dont drink…   If they dont think its that loud, ask them down sometime to hear for themselves.  Anything is better than lawyering up.    Best of luck!
