Backyard shed issue

it doesn’t bode well for your future neighborly relationship but what could he possibly sue you for? If he pursues it, the additional scrutiny will probably turn up more violations on his part. that does suck if the previous owner just chopped the guy’s shed, but the time to rectify that was when it happened, not after the property was sold.

We bid on a house that had a neighbor’s shed’s overhang about ten inches over the property line. On advicement, we didn’t want to close with this overhang.  By the time of closing, the overhang had been chopped off.  We closed on the house. Now, the neighbor wants to build it back (we don’t want it built back) and is threatening a lawsuit against us if we don’t let him.  Who will win?

If it’s over the property line, you’ll win. First thing is to hire a licensed surveyor, like Nicoletti Associates, to do a survey and stake-out the property lines. Once that’s done, it will be incontrovertable what’s on your property vs what’s on your neighbors. Ed Kopel Architects

He should not even be making an issue of this and should be happy you will allow him to keep the shed to the property line.  Sheds are not supposed to be any closer to the lot line than 3′.  there are also height restrictions and size (120 sq ft).  Steve
