Storage loft
I am looking to purchase a 650sf 1BR condo built in 2006 that has a 200sf mezzanine (it is included in the FAR) with only 5′-8″ ceiling height built above the bedroom. The unit has a 15′ ceiling and I am hoping to build an additional “storage loft” above the kitchenette and the vestibule (additional 150sf or so). If I maintain the required ceiling height for the spaces below, can I legally build additional “storage loft” in this unit?

The existing mezzanine with a 5′-8″ height clearance is not a habitalble space. Therefore, it is a storage loft. However, the DOB record shows that it is a mezzanine and uses the FAR. I guess I’ll be paying unnecessary taxes if I purchased this unit!!

Legality aside, I can see how someone (NOT me) might be able to tolerate a 5″ 8″ bedroom ceiling height, but, unless you’re VERY short, how could that be tolerable in a kitchen (or any other space that’s not mostly occupied in a horizontal position?

If you are adding a habitable space then not legally. The building would need to have FAR to give you, for which you would most likely have to pay for.
