Is this a legal apartment????

I live in a brownstone in Brooklyn. The set up is that there are 3 units on the top to floor of a 2 family building. (DOB classification is B3-2 family dwelling.) Each floor has one bathroom in the hallway that is shared by tenants on each floor (The bathroom has no sink.)The building has two open boiler violations and is NOT designated (or restricted) as an SRO. There is no Certificate of Occupancy on the building. As previously mentioned, it’s classified as. B3-2 family dwelling on the DOB website. On the HPD website, it is designated as having 9 “B” units (as opposed to “a”) Am I renting a legal apartment? If not, how do I get out of my lease??

Indeed, your landlord may be perfectly happy to let you out of your lease. If so, it might be a good idea to both sign a document called Termination of Lease Agreement. This states that you have no claims on the apartment and also that you don’t owe rent for the remainder of the lease to the landlord.

“No landlord wants a tenant that does not want to be there.” More to the point, a rogue landlord–if that’s what your LL is–doesn’t want a tenant who understands if, how, and whether the landlord’s in compliance with the law. Talk to CTFH or Housing Court help center before you go back to LL about your lease.

You are living in a rooming house (SRO). That is that you rent a room and share a bathroom down the hall. If as you claim you are sharing the bathroom with more people than you were led to believe when you were shown the space, and you feel uncomfortable living in such an arrangement, speak to your landlord. I am sure that at this time of the year they will have no problem finding a replacement tenant, give the landlord notice, pay up to the time that a replacement tenant is found, co-operate and move on. No landlord wants a tenant that does not want to be there.

@August-Thanks for your response. Because it’s hpd classification is a unit b dwelling, I think the apartment is being legally rented. (Although the it was advertised as an apartment, not SRO.) The issue is that I was lied to about the number of and gender of persons sharing the bathroom prior to my signing the lease. I would like out of this living situation (due to the fact that the terms under which I agreed to move in were false.) No on is trying to buy or sell this property so a C of Harassment may be immaterial. Even though most SROs don’t have C of O’s, doesn’t any building, irrespective of when it was built, need a C of O to change its occupany/change of use? That is, if it was built and legally used as a one or two family home then converted to an SRO, wouldn’t it need a C of O? There is neither a C of O or I card online. Lastly, the bathroom has no sink, which I’m sure is a violation.

Sorry I just read you are renting. You can get out of the lease by promising the landlord in writing that you have never been harrassed. If he won’t let you go, you can tell him you will make his life hell (and any prospective buyers). Any bin action by the landlord (e.g. delays in fixing common toilets or heating) can be interpreted as harrassment. That leads to a denial of C of no Harrassment, and that is a significant loss of money for the owner

If HPD shows 9 class B units, you have a SRO. Most SROs don’t have a C of O. There is no such thing as a ‘2 family 9 class B units’. You can either use it as is and dont change anything if you ever want to apply for a certificate of non harrassment. Because HPD likes to see the single rooms when they do a walkthrough. Any change I occupancy you want to do requires a new C of O. Before you can even start to file anything you need to apply for a Certificate of no Harrassment. The whole conversion will take at least 1 year, more likely 2 years (only for filing and paperwork and cost you hundreds of thousands of dollars (if you have currently tenants it’ll take much much longer). Any SRO buyers must be aware that all work needs to be properly filed, and there is no partial upgrade because you don’t have existing plans (e.g. electrical layout)

Thanks, @Cate Any ideas on whether or not a C of O is needed to change from a single family to 2 family 9 class B unit dwelling? Also, aren’t SRO designated for transient borders and not of permanent residents. Lastly, does the no sink in the bathroom violate building codes?

A “B” unit is a single room occupancy or SRO unit. A building doesn’t necessarily need a C of O to be legal. That’s all I know.
