Installing a bathtub in existing powder room in CONDO cellar?
Can anyone answer this: If we already have a bathroom in a duplex condo–as opposed to a stand-alone house –with a cellar, are we legally able to add a bathtub to an existing half-bath/powder room? We have no intention of turning the cellar into an illegal residence, its our rec room/kids playroom. I know that the building code was updated in 2011 (http://www.nyc.gov/html/dob/downloads/bldgs_bulletins/bb_2011-010.pdf) to allow for a three fixture (full) bathroom in a cellar under certain conditions, and it applies to a “one or two-family dwelling.” Is a condo included in that definition of dwelling? Also, what permits or C of O changes, if any, would be necessary in this case? Thanks very much for any assistance.

you can set the [built-in](http://www.aquaticaplumbing.com/bathtubs/acrylic-drop-in-bathtubs/ “built-in”) bath and then you will not be issues

Hi – just doing my own research on the same problem…have either of you found out more? I currently have a first floor & cellar apartment with an existing 3 fixture bathroom and want to renovate (ideally would add a 4th fixture – separate tub & shower). There are 3 other units in the COOP building with the same configuration (and are recently renovated) and I’m worried about opening up a can of worms… Thanks to anyone for the help!

Hi PSGAL, I meant that MDL may prescribe some limitations on cellar use, and this may include limitations on the number of fixtures. Your apartment being a condo falls unto the MDL. It is an interesting situation, that’s quite common throughout Brooklyn. Many of my clients have added the tub or shower illegally, but I have the gut feeling there should be some loophole somewhere. I’ll keep you posted if I come onto something. I was hoping the B’stoner crowd would chime in, but…

Thanks much Briank. When you say “even my expediter could not find solid grounds in the MDL” do you mean solid ground for a MDL/DOB violation or solid grounds for being able to install the tub legally? Thanks again.

extremely interesting question! I read the TPPN in its entirety, why do they limit this to 1 and 2 family? maybe to avoid reference to the MDL, which kicks in at 3 dwellings? This whole thing has always been fuzzy, even my expediter could not find solid grounds in the MDL I’m curious to hear what the colleagues have to say. Crowd-sourcing is the thing these days :)))
