DOB Violation

I received a violation provision law 28-105.1 work without a permit.  we have an illegal extension in the back of our home.  It has been there for years and we never had a problem that is till now… I have an ECB hearing in a couple of weeks.  I cannot legalize this extension.  What other options do i have to defend the violation?  Can they issue a violation for “Work without a permit” if we weren’t doing any work at the time of inspection?

Check an old Sanborn map and/or E. Belcher Hyde Insurance map to see if the extension exists. The DOB/ECB has always accepted these maps as proof. If you only recently completed the extension w/out DOB approval im affraid your SOL. The maps are available at various NYC libraries and land use attorneyes/expeditiers often have copies of them.

Building without a permit is the violation on or soon after the first page of the code.  It is like the words:  “in the beginning…”  It is a generic violation after which every thing is explained.  You can only contest the law if the terms are wrong (it isn’t building) or the law is misapplied (it is building, but it does not require a permit)  You can read the definitions and the code.  When I argued my case (succesfully) at the ECB, I was the only one who read the code.  The judge and the DOB guy (prosecutor) had to leave the room to rummage around for a copies.  The argument got off on a tangent having nothing to do with the law, which they had never read, and the case was dismissed.  It was about partitions, not an addition.  In those days, I used to get out of a lot of parking tickets too.  A lot has changed.

“I cannot legalize this extension” Yes you can. “Can they issue a violation for “Work without a permit” if we weren???t doing any work at the time of inspection?” Yes they can.
